Hi Everyone,

 

 

I'm becoming very impatient! I have a job offer and I need to start working from 22nd January. Can you guys help me to get an idea when my EAD should be approved by? 

 

Case is with National Benefit Center (MSC).

 

 

08/30/17 -- Filed I-765 and I-485

 

09/25/17 -- BIO Completed

//

 

11/15/17 -- Called USCIS, got a referral number, no feedback received

 

12/05/17 -- Called USCIS, got a referral number, no feedback received

 

01/08/18 -- Called USCIS, escalated case to Tier 2, then escalated to Tier 2 Supervisor who told me she would call back in a few days, still waiting...

 

 

On the USCIS tracker it only shows "Fingerprint Fee was received" since 09/12/17 for I-485; and "Case was received" since 09/07/17 for I-765.

 

 

Its been 134 days!

my parents EAD renewal application have a PD of 08/03/17.. still nothing...157 days... my aunt got hers right at 203 days! .. so we are getting close...try to do a expedite request with a job offer letter

Generally, renewals are automatically extended now:

In the end only USCIS knows when it's going to be approved.

Have you tried to expedite based on job offer? You can also involve your congressman at this point. I was in the same boat as you and got my EAD approval after 137 days, I think, in hand at around 143 days. They wouldn't let me expedite based on a job offer because according to them my husband made enough money and signed the I-864 that he can support me but once I got my congressman involved they finally approved it.

I actually have approached my congressman this week and today they came back to me and said that the office submitted my request to expedite based on my job offer. They also said it takes usually 21-30 business days until they hear back from USCIS. Well, okay then... I just hope that this approach by the congressman will make USCIS push it through soon, and not have to wait 30 days..

 

Does anyone have experience with this situation? Once the congressman approaches USCIS, how much time it takes for the EAD to be actually approved / in hand?

It took my congressman 2 or 3 days for USCIS to approve it but I guess that seems to vary then

That is strange because the expedition is based on financial loss to a person according to USCIS rule https://www.uscis.gov/forms/expedite-criteria, not based on financial hardship. Your husband making enough has no bearing for them to deny.

I am in the same boat. Here is my experience

 

Called and requested expedition on 1/2 based on job offer with tantative starting date 2/1.

Called again a week later, found that the person I talked to made a typo of my email. So I did not receive their response in email.

Later received email with fax number to fax the job offer. Faxed evidence the same day.

Talked to Tier 2 and was told my case would be processed by this week.

Early this week, contacted congressman. Congressman requested expedition again on my behalf.

After 10 days of faxing, USCIS is still reviewing whether to expedite...

True. At the same time, the meaning of "severe" is relative. If a spouse petitioner earned $100k/year and the beneficairy's job offer was for $25k/year, is that "severe" in their circumstances? If instead the petitioner had no job, would it now be "severe"? It's very discretionary, but I do think there is a valid argument to make that the former case appears, at least prima facia, more severe than the latter.

We are in the latter situation (neither of us has a job.) Only the beneficiary has a job offer. Really hope USCIS consider our financial loss as very severe.

Unfortunately there were quite a few people in the March AOS 2017 forum who had that issue about not being able to expedite based on a job offer when their partner was their main sponsor (and they didn't have a co-sponsor). Looking back I think I should've just kept on calling the USCIS hotline until I had someone on the line who would let me request to expedite. I think it was depending who was handling your call whether you were allowed to expedite or not. When I later (after I got my congressman involved) talked to a tier 2 Rep and complained about not being allowed to expedite based on a job offer, she didn't deny that fact either... so dunno...

I received the APPROVED email/text from USCIS on 26th January, 2018, 149 days after USCIS received my case. Guys, it really pays off to use your Congressman to petition for your case to be expedited. Get a job offer and use that! If he hadn't been involved, I'd still be waiting.

Today (29th Jan) I received the official approval letter. I'm really hoping to receive my card in a few days.

Do you mean representative or senator?

 

My representative only faxed my job offer and related materials to USCIS. Two weeks later and nothing so far. (Almost three weeks after my faxing job offer)

 

Contacted a senator with their designated form “help with federal agency” via email. On week later and nothing so far. The form did ask whether I contacted other congressman and I said yes. Would they dismiss my email just because of that?

 

Did I do anything wrong? Please help...

You did not get an RFE, did you?

 

I got an RFIE for AOS. I have responded and USCIS have not officially confirmed that they received it. Only a T1 officer confirmed that they received my response on the phone. Could this be holding things up?
