ROC status pending, can I write a parole letter for someone in Jail?

Hello everyone,

 

I know this sound maybe strange or odd but, I have a very long and hurtful journey behind me and been through some really rough times that are still going on and I don’t want to mention here any further due to personal reasons.

 

Facts are that I am going through the ROC process since almost a year and haven’t heard anything from USCIS yet. I am going through this process by myself with an immigration lawyer due to the marriage not working out. (I have all my evidence of certified and faithful marriage together and I am not worried about this, the marriage with my ex husband was faithful),....

 

Long story short I have met someone in this past year and unfortunately he got arrested (US citizen) for burglary. Now the time is coming up for him to get in front of the Parole Board and I would like to help him writing a letter to the Parole Board, that I am here for him and want to have a family with this man in my future (I don’t have any kids yet; neither does he).....

 

So here is my question :

With my ROC status still pending, could it hurt my case because I write a support letter to the Parole Board for him? Would they look me up (Name, Address, maybe see that I am a foreign nationality) in the system and maybe inform USCIS about me supporting a “criminal”???

 

I don’t know what to do, because I want to help him and feel aweful, by the thought that I might can’t help him due to my status pending?

Please help me and sorry for the long post...

I understand your fears. 

 

From my understanding of things writing a letter for the parole board would probably have no impact on your ROC. I have to say probably and not definitely because one never does know. It is possible it causes you an issue but it is highly unlikely. People have successfully AOSed and ROCd with their partner in jail. Partner being the other person involved in the petition. He is not involved in the petitions, but even if he was it wouldnt be a reason to deny you (since hes a 'criminal' as you put it). They could take issue to the company you are keeping and decide you can not make truthful statements about things (like your past bonafide marriage) and use it against you, but the way the ROC process works you need more good evidence then bad. Your involvement with a criminal can not be the sole reason for denial. So it probably wont impact ROC at all. I also doubt the parole board would contact USCIS and report you are having a relationship with him unless they feel its fraudulent or you are involved in the criminal activity as well. 

 

WHen you do biometrics- which you probably already did, they run a background check on you. Its very indepth and if you were mentioned in his criminal proceedings they already know about it. If you werent mentioned then perhaps writing to the parole board would include you in his file and again perhaps it would be known next time you go for biometrics but I doubt it would (im assuming this is a local level crime and not federal). 

 

The bigger issue is how the parole board will look at your letter and if they will believe it and if it will actually help him. They are not suppose to judge based on sex, religion, race, citizenship etc but people are human and they do it anyway even without realizing it. 

 

So basically the answer to your question is NO. Write the letter and go to the parole hearing if you want to.
