Hello all, 

 

Unfortunately I received a checklist today :( It is for my wife's (beneficiary) original birth certificate from India. I originally sent them "Copy of Birth Certificate" (english translation) which she had obtained from record's office in 2011 but NVC wants to see "Copy of original birth certificate" or if I don't have original birth certificate they would like secondary evidence such as school leaving certificate or affidavit, etc. 

 

My problem is that my wife has her original birth certificate (not in english) but that certificate is missing her name as she wasn't a name till few weeks later. Will I be okay sending in her original birth certificate without her name as her "Copy of birth certificate" which I already sent them has her name?? or should I send them secondary evidence along with her original birth certificate that doesn't haver her name? 

 

Will appreciate any inputs here.

I would send them secondary evidence along with her original birth certificate that doesn't haver her name. Also a letter explaining why her original certificate does not have her name on it

Just tell her to go to whatever authority that issues BC in her country and request a copy of her original one. Courthouses have that on file and you can request a copy of it.

We already have a copy of the original one and that's the one I submitted to NVC but looks like they don't like that. Please see below. Maybe they don't like the fact that it says copy and bcz it sates taken from original record of birth! To them seems like just translation of original I think!?

They already have this copy which I attached above with my wife's name on it, would it be sufficient if I just send them her original BC which is not in English and is also missing her name?

I find it strange that a BC certificate has no name on it. The only purpose of a BC is to verify who the person is and without a name that’s not a valid document. Have her go back to the places they issue BC and ask them to get her a new one.

Agreed, apparently back in the day in India kids didn't get a name until some time after birth and register's office didn't mind issuing a certificate without child's name!

So this is what it says on the e-mail I received from NVC. I have photocopy of the original bc its in native language but is missing child's name however, the english translation has a name.

Senda copy of the original regardless of what it has or it doesn’t have. Name or no name, that’s what they’re asking for. Just send that. A copy of the original document you had translated. No matter what language it is in.

Okay, Thank you for your help. I have decided to send original certificate with missing name and along with that couple secondary documents like her school leaving certificate and affidavit from her parents.

Don’t send the original. All they asked for is a copy of the original. If you send the original you will no longer have it. If you want you can get a certified copy of the original at any notarized place, but don’t send the original. You don’t get anything back from USCIS.

Thank you everyone for your inputs. 

 

Yesterday I ended up sending following documents to NVC

- Original Certificate without her name (non-english)

- letter explaining why name is not on original BC

- Her school records (school leaving certificate and her diploma; both shows her dad's name and her name with her DOB)

- Two affidavits from each parent stating her birth information and stating that her name is missing on her original BC


NVC already has translation of her original BC that has her name in it.

 

I hope all this will be enough for NVC, will see what happens.....
