Really weak ROC evidence

I’m definitely concerned about removing my wife’s conditional green card since we don’t have a lot of evidence proving a Bona Fide marriage other than tax returns and health insurance together. We’ve commingled no finances and we have lived in one of my mothers houses the entire time. Other than possibly getting some affidavits from family members or neighbors, what else could I send in?  Our house flooded in Hurricane Harvey and we lost just about everything which is proving even more difficult in gathering evidence.

Mother can write up lease agreement (as she should have) for you or write an affidavit detailing what she provided when it comes to living conditions (rent, utilities...). 

 

Get a proof of insurance claim for hurricane damage for items lost - had a renter's insurance? 

 

Go to your doctor and get copies of papers you signed designating your spouse as someone your doc can discuss your care with. 

Include EOB paperwork from your health insurance for each of you. 

 

Get wills, power of attorney done. 

 

Have big box (sams club, Costco) membership- include copies of those cards. 

 

If any pets - vet paperwork you get after vet visit.

Driver's license from both of you with the same address

Magazine subscriptions/junk mail with your name on some and her name on others but same address 

Cell phone plans

Do you both have bank accounts showing the same address?

Car insurance both listed

Life insurance showing spouses as beneficiaries 

 

 

I know you had to deal with a flood but it's time to think of anything and everything from the beginning of your marriage not just newly open and started stuff. 

Lacking in some of the stronger things like joint accounts and bills you really need to include everything you can find heck I'd toss in the kitchen sink.

My wife and I have a joint account for housing costs like insurance, property taxes and our car lease, but we each have our own personal bank accounts. We both make grocery purchases or pay bar/restaurant bills (not strictly taking it in turns, but it roughly balances out).

 

As well as lot of other documents we had showing co-mingled finances (eg house ownership docs, tax returns, etc) I submitted copies of our separate bank accounts and credit cards because

1) these show the same home address

2) if we eat out sometimes I pay for dinner, and sometimes she does, so our bank statements both show payments to the same bars, restaurants

3) when we both travelled for vacation to New York and Canada we will both have payments on our cards in those locations over the same period

So even personal separate bank accounts can show that you're living joint lives with each other

 

You can also submit things like photos you've taken on vacations, or days spent with family, friends. Photos of Christmas with family, etc. If you share a car you probably have one of you named as primary and the other as named driver. If you have a car each you will have registration documents listing same address (as with drivers license).

 

You are trying to show that you are living a life together, and its not a sham to get a green card. Think about how difficult it would be to put the above things together if your marriage wasn't really genuine.

You can also include and write an explanation letter explaining on the Hurricane Harvey damages that caused you to lose majority of the evidence. Provide some pictures/information on it.

I also submitted my ROC in March 2017. I am in a similar situation to you too. I didn't even send any affidavit from family of my living situation. I only sent what I had: IRS transcripts, birth certificate of our son and medical insurance info. I will let you know soon if I have an RFE or not.

A birth certificate is pretty good evidence that your relationship is genuine!
