Want to take spouse and two elder childrens but not younger one will it effect the visa process need advice! (merged)

Hi i am u.s citizen currently in U.S and applying Ir1 for my overseas spouse in Pakistan and IR 2 for my under 21 son and F1 for my over-21 daughter.

The thing i am worried is that i am not applying for my younger son 14 year old as currently he is studying in her aunt home.

Her aunt wanna adopt him coz she had no children.

Will this effect the petitions for spouse or other childrens?

Will embassy procedure be complicated by this?

That why are you not taking your younger child and taking other ones?

Will he be discussed in there for my spouse interview or other children interview?

As islamabad embassy had a bad reputation of asking irrevelant questions and than wasting time on investigating them.

Thanks for you some kinda advice for me.

I don't know and I don't think anybody would give you a simple answer cause nobody know what would they ask. Why don't you apply for him get him a U.S. passport and he can come back and do his studies and can live with his aunt.

If you show them the adoption paper then it shouldn't be any problem.

I might be wrong on judging this, is just I don't get it, but ¿how is that you just give in adoption your son, because her aunt doesn't has children?

 

Idk for Pakistan, but I read another post where the OP husband was questioned about not taking with them their younger daughter. I believe they were not able to support her in the US. and the CO wasn't convinced about it. I think it was Nigeria.

In essence, I don't think they should be upset with the fact that one less person will be immigrating. However, this may cause concerns about the moral character and the strength of the family ties. That is against the original purpose of these family-based immigrant visas - respecting family ties and allowing families to live in unity. 
If you are giving away your kids (even if it may not really be the case) as a consolation gift to your relatives, it may be viewed by the Consulate staff as a sign of disregard for family ties that these visas try to honor and support.

Because a US passport is a minimum of three years to five years away...  By then a significant amount of his studies will be behind him

He is a U.S. citizen and his son would get a U.S. passport right away and he can review that passport right away when it gets expired.

I am U.S citizen.

I have three children.

A younger son age 12 years

A elder son age 20 years

A daughter age 22 years

And my wife.

They all are currently living in Pakistan 

I want to petition i130 for my wife and two elder childrens,but not younger one now.As he is currently staying with her aunt and studying here.

I cant afford his study in U.S

Will this affect family migration?

I heard somewhere by doing this i am affecting the family migration procedure.

Would they ask me why you are not taking your younger child?

Will there be any delay or investigations regarding to this matter?

now your oldest child will take over 7 years and as long as she remains unmarried

 

either way, you should file for them now, so for now, you will need 3 of everything except for the i130A which is for your wife's petition

-Your wife and your younger son can get a visa around 12-14 months.

-For 20/22 child they will aged out,so may be 7-8 years.

-For the study: high school is free in US. You have to pay for him when he go to college, but he can get federal grant(fafsa) to pay for it if income is low.

The 20 year old won’t age out if he petitions before they turn 21. CSPA will freeze the child’s effective age as of the time of petitioning.
