Hi there, I really appreciate the knowledge I've gotten on this forum. Thank you all.

 

I was looking for a lawyer to file our up-coming i-751 Removal of Conditions form. We could probably do it ourselves, but just don't want to mess anything up. 

 

Found a lawyer on Avvo because of a comment he wrote a couple of years back that "he has never in 20 years seen an i-751 client of his have an interview request" . . . I then called his office and the receptionist there told me that ALL I-751 applicants since 2017 now have mandatory interviews -- ever since Trump got in power. According to her, waiving the interview is a thing of the past and we can be 100% sure we'll have one too.

 

Is this your experience too? My wife and I have a completely legit marriage with tons of paperwork and documents to back it up, so either way I'm sure we'll be fine. But I would rather have avoided the interview. After all we already did one 2 years ago and it was stressful.

 

Would truly appreciate your feedback!

I've seen another VJ member saying this before but I personally have only read that all AOS interviews are mandatory now (some were waived before for AOS from visas such as K1s). I never heard this about the I-751 though. That would be pretty messed up because my only comfort about having the AOS interview after already going through the K1 interview was that another interview for I-751 would've been very unlikely -.-

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I-751 interviews are not mandatory. They do interview a very small number of applicants, Good luck.

Very happy and relieved to hear this. I guess you shouldn't take legal advice from a receptionist after all.

I don't think the thread needs to be deleted - just clarified. Here's a great article that spells it out:

In theory, an in-person interview is "required" for any process that results in the issuance of a green card. However, in most processes where a green card comes after another process that also requires an interview (like ROCs and AOSs - where there was a visa interview at some point) the USCIS has waived the  interview requirement in most cases. 

 

45's administration, as part of their "extreme vetting" mandate, is trying to cut back on the waivers, so they've made it against the rules to waive the interview for:

  • People moving from an employment-based visa to permanent residency
  • Family members of refugees and asylum seekers who are applying for "provisional status" (the step before permanent residency)

Removal of Conditions applicants are not included in this new rule. But some people don't read the whole story before they jump to conclusions.

 

It's not "fake news" - it's an incomplete understanding of "real news". Of course my favorite part of the article is where they admit that those waivers started happening because another in person interview was "a colossal waste of time". And look, here we are, a year behind in processing ROCs.

Why people get too much worried about interviews? personally I don't get so much stressed about it, If I get the ticket for interview, so be it. I guess since the K-1 long waiting,  going through the process don't get me so much worried.

It is scaremongering and even the USCIS field offices seem to say this, as quoted by someone who had an info pass. My experience when I went for biometrics, I was told i WILL get an interview and it wouldn't take around 12 to 13 months as i had stated. How wrong they were, I'm now on month 11 with no approval, so my prediction wasn't far off and I haven't received a request thus far, only wish i had months ago, so I could put ROC behind me.  So reflecting on what i have mentioned it seems it's not only lawyers receptionists that are reading it all wrong, but also field officers, which is another reason why we all sit here so confused as if they don't know how are we meant to know, until someone as above found the relevant information to once again clarify the situation.  

 

That said they do interview some AOS cases more than ROC cases, but there are the odd few of ROC cases they interview and from looking back at posts from the past, they tend to be ones that have insufficient evidence or changing from a different visa other than K1 or such.  However, when they first decided to make some AOS interviews compulsory they did say they would roll out compulsory ones for ROC in the future, but we all know right now that is not physically possible due to the demand on man power at the field offices.

Removal of Conditions..  TICK TOCK, TICK TOCK

 

Time to reset the tick tock clock again.   Roll my eyes.

Again, I dont trust on any words given by the lawyers or any USCIS employees, those words were BS. I would rather do my research so I can have a proper black and white documents to slap on their faces rather than hearing it  from word of mouth. LOL!

Mandatory interviewing all ROCs? Give me a break, the system is already completely overloaded and ROCs are pretty low risk anyway.

 

Most of them had either a K1 or CR1 interview in home country, in case of K1 jumped through the AOS hoops (some with interview) and a lot of them will move on to N-400 with another interview in about a year's time.

 

USCIS does not have the resources to implement this, nor does it make any kind of sense.

 

Maybe they'll interview more divorce cases and maybe they'll interview more cases from whatever the current list of "bad countries" is to placate the populist government, but never all ROCs - very likely not even anywhere near all family AOS processes.

It's not about the worrying of interviews, but that means there is a bigger waiting time, and you have to wait and wait and wait!

Please note that some people have very traumatic experienced when it comes to immigration interview so that's why most of them don't want to experience again, that is why for them interview is a nerve-wracking experienced.

Same here.

I don't care about the interview. Our marriage is bona fide and there is nothing to fear.

 

Perhaps some people are afraid of the unknown (understandable) as they have interviewed at consulate but never at field office before.

 

Well, for those that don't know, the interview at field office for 2yr green card (AOS) was very pleasant. Questions were easy and the USCIS lady was very charming and had a nice office with books, nice decorations and a few family photos. Nothing scary. We actually shared some laughs.

I don't see why I-751 interview would be any different.

 

Interview is nothing to worry about if your marriage is real (not fraud)
