Hello,

 

My exfiancee and I had problems and we won't get married, and honestly don't want her coming to my house either.

 

What's the procedure to cancel the already approved visa other than waiting for it to expire? We did the interview and absolutely every step is approved, she has the visa in her passport.

Seems like a drastic step considering how long you probably waited for the visa. 

USCIS is the wrong place.  The USCIS is done with this as the file has already gone past the visa issuance stage at the Embassy

I will assume me you have told her it's off. If so and she comes to US it's on her and you have no obligations. In 90 days she should go home if no marriage. Anyway would would have expired.  I know there are so many variables it had to the the complete situation to respond to.

Obviously nobody is going to marry them against his will, but financial responsibilities is another story...

Wrong. I-131 is not enforceable and at this stage he did not complete I-864. No financial responsibility for him.

You mean the I-134? What makes it non-enforceable? It has some strong and very clear language, particularly in the certification part of it.

Keep in mind that I-134 has been updated a few times. Just because it was not enforceable 20 years ago, as it was badly written.... Well the language of the form has changed.

 

Not saying you are wrong; simply would like to know what makes the current I-134 non-enforceable.

Because it is for a non-immigrant visa. Forms enforceability didn't change in time.

To the op: you don't have the obligation to marry or for her to come to your house even if she enters US.

 

as said already; her k1 visa would have your name on it and the adjustment of status once entered to US can only be done through you, which without a marriage and you being on board cannot be done.

 

she won't have any choice but to go back even if she uses it.

 

if you want to take action; you can call the embassy, however if she already has her passport back with the visa I don't think you can do anything about it.

Some members have called CBP to let them know and flag the visa. I don't know if it works or not as I never read any updates. It's worth a shot at this point though.

That can totally work especially if embassy doesn't get the beneficiary to return so they can cancel the visa before he/she travels.
