I like visa fraud.  It sounds more sinister!  😝

I also like the term illegal aliens.  It sure beats "undocumented workers" and all of that politically correct nonsense.

I think the first thing to cross a CO's mind is how committed were you to the petitioner to find time to court someone else in that time.  Keeping in mind that you were presumably living with and supported by the petitioner that whole time.  And that's looking past the petitioner is who you swore you were going to marry and why you got the visa. It has fraud and dishonest  intentions written all over it.  Aside from the fact your K1 is limited to the petitioner (who you convinced USCIS you were in a committed relationship with) , not a free pass to marry any citizen.

Yes you can marry someone else, but you should go back to your country and do CR1 process and you sure will have a hard time to prove your marriage is genuine , and there is still possibility the second person will not be submissive, be into drugs or trouble maker or dictator since you can't know a person in less than 90 days. Will you risk it again and again until you find a USC who meets your standards?

You still have the problem of explaining you met and fell in love while on a K1 Visa with someone else.  Not very heart warming.

I think that is Capital letter NO to visa fraud, for someone who want to embark on a life time journey who is leaving thier well paid job to settle down in marriage needs to be extra ordinary carefull, while carrying out a risk assessment u think about possibilities and severities, if probably *shes*  for instance is a woman who is not submissive, into drugs, fornication, trouble maker, dictator etc..and all this cant be detected during the distance relationship.. will U proceed with such marriage??.. if the spouse already resign his high paid job and have nothing to go back home for. If the spouse had someone in mind b4 why is she not the petitioner in the first place...  We all need to be positive about our reasonable and comment on net...i dont think considering both positive and negative of a step is bad.

No judgement here, just maybe listen to your own point - maybe take those precautions and be extraordinarily careful just like you said so this doesn’t happen again.  Considering marrying someone just after a failed engagement is probably not the best idea, nor anywhere in the realm of extraordinarily careful - regardless of visa laws

Citizenship process complete!  First a J1 work/travel Visa visitor from Philippines to Texas where we met each other, then back to Philippines.  Ultimately, immigrated here via a K1 Marriage-based petition in 2016, AOS started in 2017, completed in 2018, ROC started/completed in 2020, N-400/Citzenship granted in 2022 - timeline link below:

Yes, that's why i said he will have a hard time, and my reply meant to be sarcastic (i failed lol). All i wanted to say was it does not seem right either way, even if it is not illegal.

The K1 visa doesn’t keep you from marrying someone else, but if you do marry someone other than the original petitioner for the K1, then the only path to become an LPR is to leave the US and have the Now spouse file for a spousal visa.

That is exactly what I wanted to say. if OP is trying to use the same K1 Visa with someone else.

Yes you can!  However, you would be hurting the person that took their time and effort to sponsor you.  If they love you, that is terrible!  If you break up and you honestly fell in love with someone else and marry them, that is your right.  However, you have to leave and go right back to your country.  The original petitioner should not be responsible for you.  Also, when your US spouse files a spousal visa for you, be prepared to have it highly scrutinized and possibly denied.  If you genuinely fell in love with the second person, however, you shouldn't care about staying in the United States anyway.  Your priority should be your marriage and doing right by the original petitioner.  The person you marry should be told up front that you have to leave.  I hope this is a hypothetical question!  You could also go back to your country and have the second person go back with you and marry you in your country.  I hope the focus is on the marriage and not the staying in America.  I probably already said that in different words, but I mean it.  All of this is about people and not papers!

This would all require the beneficiary to fall in love with one person. Go through the process. Move to the states.  Realize you dont love the petitioner.  Meet and fall in love with another US citizen and get married...all within 90 days.  I'm still thinking fraud.  My guess is so will the CO.

Yes, just make sure that you pose this hypothetical situation at the POE to the CBP agent. He/she will gladly provide you with timely information.
