My 10 year resident card expires 31st March and my employer wants me to show proof that I am legally allowed to continue employment.

I've been for my biometrics appointment and am waiting for new card.

I heard that even though my card expires, I am still legally allowed to continue employment etc in the US.

Do I need to present proof or am I in the clear here?

Advice appreciated.

You are in the clear. See https://www.uscis.gov/i-9-central/51-reverifying-employment-authorization-current-employees.

Note: Reverification is never required for U.S. citizens and noncitizen nationals. Do not reverify the following documents after they expire: U.S. passports, U.S. passport cards, Alien Registration Receipt Cards/Permanent Resident Cards (Form I-551), and List B documents.

You are ok to work, but if your employer wants proof that you are, get him a copy of your renewal receipt or NOA, or whatever you got after you applied for your renewal.

The only thing I have is the receipt that I did my biometrics.

You can technically sue your employer for discrimination. They are not allowed to ask permanent residents (conditional or not) for renewed proof of residence.

Wonder why you didn't go with driver's license and unrestricted SSN for employment purposes? That's all I ever showed to my employer.

My drivers license expires when my resident card expires.

Your status as a lawful permanent resident, a.k.a. Green Card holder, NEVER expires, even if the document does.

Still, you'll have to provide proof about (1) who you are and (2) that you are authorized to work.

The accepted documents for that are on the bottom of the I-9 form, in List A, List B, and List C.

List A documents prove (1) and (2).

List B documents only prove (1).
List C documents only prove (2)

A = B+C

About 98% of all people do that by showing their driver's license (proves 1) and their unrestricted SS card (proves 2), US citizens and Green Card holders alike. I've NEVER shown my Green Card to any employer.

If you don't have a driver's license or state ID, get one before your Green Card expires.

Problem solved.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

My employer told me the other day, that I'm ok to work even though my card expires and that they don't need to reverify my status as I'm a permanent resident. Thinking a bit of research always gets things sorted out....

To top it all off, my new card is already on its way. Only took 2 months to get my new card renewed.

Thanks for all your help everyone.
