My fiance was brought over on a tourists visa as a child and her parents stayed past their visa. Well she now has legal status with a work visa. We plan on getting married and have been together close to 6 years, wondering what we need to do to get her her permanent residency. She is eligible for her residency September 2018 without the marriage but the lawyer and fees are over 5000 and he states that she probably wouldnt recieve her residency until end of 2019. So was wondering would it be faster and more cost effective the marriage route or keep going the way she's going and wait on marriage until after she receives her residency?

Cost effective would be doing it yourself, even using one of those visa services would be cheaper than that.

As far as wait time, there's nothing that will speed it up.

Marriage route generally takes 12-14 months

Received and paid IV bill: 9/19/2017    IV bill cleared bank: 9/21/2017

Requested Expedite: 9/20/2017

AOS and IV show as paid: 9/23/2017

DS260 unlocked: 9/23/2017

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

How did she obtain residency? What is her status now? There is no such thing as "resident" without permanent residency.

If she has legal status marrying you won't change anything.

if She’s there legally now you can get married and adjust status because you can prove that she didn’t travel there on a tourist visa with the intention of marrying you and adjusting status. If neither of you has any complications like a criminal record or illegal status, you can do it yourselves and save the lawyer money. Just be very thorough, organized, and attentive to dates and forms.

She can adjust through marriage, no idea about the process she is going through at the moment. Nothing I recognise.

When dealing with immigration, the words "fast" and "cheap" should be removed from your lexicon.

 

Interested on what status she currently have and how she obtained it. You say work visa, do you mean H1B?

She had a ex bf that beat her and kidnapped her when she was 16. I don't know the process but the lawyer was able to get her mother, father and Her little brother all work visas, they renew them every 2 years I believe. Well come Sept they are eligible for permanent residency, the lawyer is going to cost 5000 a person to finish the process, but they are now all on their own, but he said they wouldn't recieve their residency for close to another year and that they would recieve a year extension. I mainly wonder if we can marry without it hurting that process and if we did would it move it along faster. If it helps i am a veteran and currently serve in the national guard, I have asked my chain of command about it but they haven't came up with any solid answer though they believe there is something we could do.
