Hello folks,

So two days ago i got a letter from USCIS saying my AOS case has been closed because it seems i "abandoned" it. Apparently, they sent me invitation  for my AOS interviews on Dec 20, 2017. Unfortunately, I never received the mail and missed my appointment. I haven't changed my address and all previous paperwork from immigration were delivered here. I have no idea how this particular mail never got delivered. I have a feeling it was an error on the mailing system. Unfortunately, USCIS seems to be bent towards making me to pay a price for an incident that I'm solely not responsible for. 

Has anyone encountered such a scenario? And what ideas/advise to you have? Thanks!

You say they seem bent on making you pay a price? How so?

 

I can understand if something got lost in the mail, but they are just following procedure.

Did you see if any updates were made in their system?

 

Have you tried calling them to see your options?

Received and paid IV bill: 9/19/2017    IV bill cleared bank: 9/21/2017

Requested Expedite: 9/20/2017

AOS and IV show as paid: 9/23/2017

DS260 unlocked: 9/23/2017

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

Some of the recommendation they put is i can apply to reopen my case and part with a fee of $695. That's the price they want me to pay for something I'm not responsible. I mean I never showed up for interviews because their invitation letter wasn't delivered to me.

 

I have tried calling but no one will pick...very typical of USCIS

Make sure your name is on the mailbox, make an infopass to ask them to open the case or request it through your senator.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Yes, my name is well written on the mailbox. And i didn't know i could go through my area senator. I will look into that. Thanks!

Also make sure you sign up for USCIS email/text notifications if available.

I don't know if they are in your case, but while going through CR1 the option was available.

I know for a fact you can at least check your status on the USCIS website

Ok..so you  HAVE gotten mail from them before this....but my question is why didn't you keep track of your status on the USCIS website? During my wife's AOS it clearly showed updates on the USCIS website and her appointment date and time was posted about a month in advance (this was in addition to the letter in the mail of course). So even if  your mail was lost (it does happen, sigh) you still would have known by just looking up your case number (given with your initial letter). So I see it as your fault since you did follow through with checking on the progress of your AOS. In my wife's previous letter from USCIS before getting the final interview notice it said if you don't receive a letter by such and such date to call USCIS, this was also on the USCIS status site also.

Java2, we did look up his status on the USCIS website and guess what...the last update is from August stating his work permit had been mailed. Nothing else has been posted...nothing at all about an interview for the green card on December 20th. So I highly doubt this is his fault. I’m glad things worked out smoothly for you but not everyone can say the same.

Well, something wasn't right for sure, hopefully they can figure out what went wrong.

Hey! I’m on the same situation as yours. 

My interview was on February 6th... apparently... I have the app on my phone and check the website everyday... « case is ready to be scheduled for an interview » since march 2017 and « card was mailed to me” since June.

I have been told not to send the $675 form if your reason is “I haven’t received the letter” because you will pay for them to tell you to start all over again. 

I spoke to a friend of mine who’s a lawyer. He told me to take an infopass appointment, bring with me copies of both the app and the website showing that nothing happens and pretty much praying it works out...

I'm not sure if this has changed or if it's just different depending on how/when you filed, but I received three NOAs with different case numbers. One for AOS, one for EAD and one for AP. I filed the EAD and AP with the AOS back in October of 2017. When I look up these numbers on the USCIS website, it shows me the status and for which form. Is it possible that you only received the NOA for the EAD or was it all grouped together as one case last year?

Hey Florine, 

We actually tried to get an appointment with the Des Moines field office when this all happened but they were booked out for over a month and since the letter said we needed to file the appeal within 30days we didn’t feel we could wait. My husband actually got a hold of someone at our local senator’s office and they met with him the next day. They scanned in all his files and were able to refer it to someone they knew with immigration. They took the lead on everything and we were notified that a new appointment letter would be sent. It was and we went for his green card interview February 12th. Everything went well and he was approved :). I would definitely recommend getting a hold of your local legislators office.

we just received a letter of denial for AOS  because we missed the Interview date. Last time I checked the USCIS website it said that the Interview is waiting to be scheduled and that we will receive a letter. We never received the letter for the Interview. This morning when I saw the mail from the immigration services I was excited because I thought it was the Interview letter, and when I opened it I was distraught to see the denial.  What is the next step I should do? It also says that my husband's employment authorization is immediately invalid and can not work. DO I file for them to reopen the case? or do I schedule the infopass appointment or do I contact my Senator.  and can he still go to work because there was an error,
