Hi,

 

First of all thanks to everyone who has been responding to queries and sharing their VJ experiences. My question relates to filing for condition removal on my marriage based green card. My card expires in mid August and the window to file for removal of condition opens in mid May. I had originally planned to submit the I-751 on the first day of the 90-day window. However, looking at the process of NOA and biometrics I'm wondering if I should delay my filing until early July because I plan to be out of the country in June. I'm concerned about filing and leaving the country during the adjudication process. But I'm also worried if I'll be pushing the timelines by waiting to file until the first week of July for a card that expires in mid August. 

I'm based out of Chicago and expect the processing to be done out of the California service center. Looking for the group's opinion based on your understanding of the timelines/process on whether I should:

  • Apply on the first available date and not worry about leaving the country as long as I return before my green card expires
  • Wait until first week of July to apply after my return
  • Change my travel dates so I apply a little earlier (I'm thinking 3rd week of June)

It's an application window.  You can submit the application anytime between window opening and the expiration date of the card.  Upon application submission you will receive a letter extending the current GC for one year while the ROC process is occurring.
