Your initial post still doesn't explain how a school advised her to attend while she was here on as a tourist. Did a teacher randomly walk up to her and tell her to start going to class? The story doesn't add up.

As stated previously "under the high school's advise started going to school on their B1/B2 visa". Dean,Principal and student advisor directed us in this direction, as they had stated they had directed multiple students.

Just wanted to get advise on CURRENT situation, appreciate all that shed some light on that.

The average Dean, Principle, and Student Advisor at a school likely knows less about immigration rules than my garbage man. Regardless, it is on the visa holder and guardian of the visa holder, if they are a minor, to know said rules. As stated, the decision for her to go to school while on a tourist visa will always lie on her shoulders, not those that advised her to. Something she should be aware of moving forward.

 

If she is able to get a visa in the future, she should be well versed in its policies.

I visited many countries when I was of school age, never occured to me to sign up to attend a school in any of them.

No matter what the school said, the fault for her using the wrong visa must be laid on her parents or whatever adult she was living with.  Google existed 10 years ago too.  You can’t expect a high school kid to know what visa to use especially if told by adults to use something else. OP, I understand you think this is irrelevant but unfortunately it’s not - it’s having a clear impact on her visa applications, and I think that’s especially sad because I don’t think it’s her fault but she’s bearing the consequences.

There's a chance, but as others have indicated it isn't a big one. 

 

The US tends to dislike people abusing visas, and so makes it very difficult for you to do that twice.

From what I understand from your original post, there has been a total of 3 visa denials, correct?

Unfortunately, most likely facing a 4th denial unless her personal circumstances have changed drastically...and even then, hard to overcome the prior abuse.

The issue is that she is not allowed to attend school while under a tourist visa.  The school never should have enrolled her, and it is against immigration law.

And yes, it WILL affect her current situation now, even though it wasn't "her fault" necessarily.

OP was  clear this was a school issue and not parents.

Do you buy that? If a school told you that would you take them at their word or would you have already looked into it? It is ultimately the parents’ responsibility to ensure the children are on the right visa.

something fishy must have been going on anyway for the kid’s bag to be searched and the textbook found...? Only time my bags have been opened by CBP was to check the food I’d brought was ok, and when I had some lead weights in a suitcase (lead shows up as blank on the X-ray and I knew they’d open to check that).
