Some advise please.

My sibling is going in for B2 visa interview. Initial visa was cancelled/withdrawn a decade ago when under the high school's advise started going to school on their B1/B2 visa. Never overstayed, but on a re entry customs found high school book in suitcase, sent back and visa cancelled. They have applied after (twice, about 4 - 5 years ago, in a different country, when was a student) and denied. Sibling now lives in another country, is employed full time and applying again for just a week visit. Any idea on their chances? Any advise on how to answer questions?

 

Any help would be appreciated!

Does this mean it will be a slim chance for her to ever get a B2? Does it make a difference (negative or positive) that I'm a US citizen and our parents are Green card holders?

That's a negative, shows strong ties to the Unites States and even less reason for them not to abuse the tourist visa. And that's on top of previous abuse.

Sounds a negative especially with the prior abuse.

 

You can sponsor her for an immigrant visa.

Interesting, they have no interest in moving to the US. But the D-160 did ask this, so they did answer truthfully.

Lying in the D-160 would be much worse. They already know the answers to all the questions, just seeing if you're being truthful or not.

Unfortunately your sibling was using a previous visa for a purpose not allowed by that visa. Judging by presumed age at the time this was probably not even her “fault”, but it remains against her name. Violations of visa requirements tend to have a long impact on future travel to the US.

By “they”, do you mean she has a family? The more ties she can show to her home country - family as well as job - the better her chances of being granted a visa. Do they own property?

How do you accidentally go to High School when visiting?
