fraudulent spouse

Hi good people. I am writing because I brought my spouse to the us not knowing that is a fraud. He deceived me not knowing that he had his plans all worked out until he came into the United States.  We had a baby together and couple of weeks when I got home from the hospital he called the police and moved out .  Right now we are going through a divorce in which it is time for him to remove his conditional residency . Please advice me on what to do because I don't want him to stay in this country.

You can report the suspected fraud but you cannot demand his removal.  He will go through due process.

Not much you can do now.

 

Just so you know it is not YOU who are removing conditions of his green card. It is HIM. This part of the process belongs to him. You are involved because it is based on him being married to you, a US citizen. He can still move forward with removal of conditions with a divorce waiver. As stated, you can inform immigration of your suspicions and provide all of the evidence you have. But don't expect him to be removed from this country. He is likely here to stay.

 

This is just a hard lesson to learn.

Just because he turned out to be an ####### doesn't mean it was fraud. Move on and find someone who loves you and make sure to really get to know him before you get married again.

He is a fraud but you have a child?  Going to be difficult to sell that one.

mmmm... having a baby together is usually the best way to prove the marriage was legit...

Could it be that the marriage went sour and now you are seeking for some revenge?

Wouldn't it be better to have him in the US to help (financially or whatnot) supporting the child?

Just saying.... people who commit marriage fraud tend not to have kids...

Sad indeed.

But that'd be one more reason to keep the father in the country to have him contribute at least.

But I suspect this would be some sort of revenge through deportation proceedings.

That isn't true at all.  It is one of the reasons that having a child together isn't considered enough for bonafide on its own.

 

Lots of people in greencard marriages have kids.  It is hard to convince your intended target that the marriage is legit without the marital relations aspect to it.  Most pregnancies are unintentional.
