Hello Friends,

 

Filipino wife came here on K1 Visa, April 11, 2016. She currently has her two year green card. We will being filing on time the 1-751 ROC in August, 2018. 

 

The problem is when we married on April 30, 2016, we forgot to file the (ROM) Report of Marriage to the Philippine Embassy in San Francisco. It's now over 1 1/2 years past due. I'm in the process of completing the ( ROM ) application now. 

 

We will be filing it by mail to the Philippine Embassy in San Francisco in the next couple weeks. I understand, we now since being late need to include an affidavit of delayed registration, duly notarized.

 

Here are my question's:

 

1- Which documents need Notorized?

2- Do we only send copy of Biography page of our passports?

3- How long will it take before my wife can renew her Philippine passport in her married name, will they send us notification that marriage is now registered in Phillipines, if so, how long does it take?

San Francisco is a Consulate not an Embassy.  The Embassy is in Washington DC

I recently filed ROM ( November ) to the Philippine Consulate in Los Angeles California. I take it your marriage took place in San Francisco? You can, as well, file it in LA ( mail or walk-in ). I am from AZ but I went to LA since we were on vacation in California. I’d say it was faster and easier. It only took me an hour for the ROM to be finished, then I also did my passport renewal on my married name right after the ROM was done. However, if you are sending it by mail, it might take a bit longer.

 

1. Only the Affidavit of Delayed Registration need to be notarized. At least mine was. Make sure that you have your not only marriage license, but also the marriage certificate. I had my Affidavit of Record of Marriage and that worked.

 

2. Biographics data of passports are needed in passport renewal, not ROM. They might, however, ask for an identification from you and wife which you can also use your US passport, birth cert, or any ID.

 

3. She can renew her passport right after her RoM is done.

We live in the State of Washington and were married in Idaho, so The Philippine Consulate of San Francisco has Jurisdiction.

 

We are really confused about the marriage Certificate or Marriage License requirement, our Marriage License says followed by know all persons by this Certificate. This is all we received when we got married, it's titled as Marriage License, but also says it's a certificate. It shows no witnesses, you are not required to have witnesses in Idaho where we got married. There is also no mention of prior number of marriage contracts on our marriage license. Here is what the instructions for ROM application says, which we don't understand how to proceed.

 

One (1) original or certified true copy and five (5) copies of "Marriage Certificate" or Contract (original will be returned) showing the number of marriages contracted by the parties and issued by the Office of Vital Records or any other appropriate office of the State where the marriage took place. if the number of contracted marriages do not show, one certified copy and two regular copies of the marriage license showing the number of marriage must be additionally submitted.

 

Please can someone explain according to the above instruction's what we need to send?

I was interested in knowing the difference between the Marriage License and Certificate is as well.

We just got Married in Hawaii and Have the Marriage Certificate...

Our License was issued before we got married stating we had 30 days to get married, so The Certificate is the Final Document..Correct?

You're correct, I was confused as to why Philippine Consulate of San Francisco asks for both when filing (ROM). My marriage license and certificate is one document. There's no mention on it of how many prior marriages.
