Child listed but child isn’t traveling with Beneficiary

Hello,

 

Im filing from Haiti but just want to ask this general question as well. I’ve read somewhere on here that if the beneficiary has a child, even though the child isn’t traveling with the beneficiary (if approved) they still need to bring their child’s birth certificate or “acte de nassaince” to the interview? Anyone know if this is accurate?

 

What if the child hadn’t been in the beneficiaries life for years due to the mothers refusal and there’s no relationship between the mother and beneficiary? I just want to be prepared so that if it is needed my fiancé can start seeing how to go about getting it now. I’m far from being near the interview stage but the child was listed on the I-129F and I wouldn’t want this to be an issue the day of.

As far as I know it is only required if the child is seeking a visa or will seek a visa (follow to join) as well.  Some Embassies have different requirements however

Thank you for your quick response! I hope that’s the case cause it’ll be a hassle for him to get these documents from his child’s mother. I wonder if he can obtain it himself at the hospital the child was born in or through the court, I’m sure they have records of it, no?

You do not need the child's birth certificate if they do not plan to immigrate with your fiancé.  Just list them on the petition.  The child will not need to be listed under the affidavit of support as part of the household (down the line).  This is a question I have seen before as well.  Good luck!

12/23/16 - I-129f packet received

1/5/17- NOA1 receipt date

1/10/17 - NOA1 Hardcopy received
