Hello all,

 

My wife entered the country Nov 16, 2017 after going through the entire immigration process.  We just received her green card in the mail, and we believe the expiration and issue dates are wrong.  Am I correct in thinking that if she came in on a CR-1 visa, that her "residence since" date should be the date she crossed the border?  Currently, the month and day are correct (11/16) but the year is wrong (2016).  On her card, it shows that the card expires 11/16/2018 which would be one year after her arrival date (should be 2019).

Can anyone here confirm that the date is indeed wrong and that I should file an I-90 for a replacement card?  Any idea how long that could take?  Will we run into any issues if the incorrect expiration date on her card passes, and we have not received a new green card?

 

I can't believe that they made this mistake after all this time, effort and money.

Please help!

yes its wrong... it should be the date from when she got admitted to the country... so 11/16/17...until 11/15/19. Send the paperwork for a replacement. It will be free since its there mistake.. it will just take a while. It happened to a family member of mine as well But once she got the NOA she went in for a info pass and got the stamp on her passport temporarily

Thanks for your response!  It was the response I was expecting, but it is still tough to hear!

A few questions for you on the I-90:

  • On the I-90 form, I should choose "Conditional permanent resident" or "lawful permanent resident"? (Assuming C.P.R.)
  • For the reasoning- should I choose "DHS error" and send in her green card along with it?
  • For: "location where you applied for an immigrant Visa" and "location where your immigrant visa was issued", is that the US consulate overseas?  Or is that simply "USA"?

Where did your relative go in for the info pass?  A USCIS office?

 

Is my wife still able to work while this is pending?  We have already gotten a SSN # for her.

if you guys where married for less then 2 years on the date she entered the USA..then yes. Choose Conditional Permanent Resident.

Yes.. its DHS error. I would make a brief cover letter explaining what happened and yes you have to send the GC. Make sure you make multiple copies and also send it in certified mail so you get a card back showing someone signed for it!

 

and yes, after you send the documents you will get a NOA... its a receipt of acceptance..with that go in to the USCIS.GOV website and search up your office that is closer to you and book a info pass apoinment. There you and your wife will be able to show the NOA and explain the situation and they will stamp the Passport... "this will be proof of legal status until the updated GC comes in " with that your wife can work, travel, ect.

 

it took 7 months for my aunt to get the new one.... but it doesn't affect anything..remember the stamp will be equivilant

I guess it's not as bad as I thought-  just a minor pain.

Regarding the I-90-

honestly , yes it is issued overseas BUT it doesn't become .... I guess official till you got through the POE... port of entry.. I would use what ever POE she entered through as the answer.. and like I said, all of this you can also explain in the cover letter...

I had the same issue as your wife. We filed the I-90  to have my green card replaced with the correct date. Even though we did that in May already, I have just received a notice that I have to remove my conditions and send form I751 in three months or I could lose my permanent resident status. This is based in the incorrect date I received. Have anyone had this issue before?

My God what a nightmare... The only thing I can tell you is that when I called the uscis, they told me to not worry about it, and to check your I94 online.  That should show your correct admission date and a correct expiration date (2 years later) in Nov 2019.  In our case it was correct. I filed my I90 in March I think and I'm still waiting for the new GC...

ALMAP--- update for you.  My tracking status on the USCIS website went from "actively being reviewed" to "cannot provide an update at this time".  We called USCIS and talked to tier 1 support.  They said they couldn't track it either and they had to transfer me to Tier 2 support.  Far and away best customer service I've ever gotten from the USCIS.  I explained in detail exactly what had happened with the expiration mixup.  The officer was a little concerned and understood our worries about the request for form 751 later this year.

In turn, she asked me if I was 100% sure that it was a USCIS error.  I said yes- "look at your records.  you have absolutely no record of my wife in nov 2016 when it says she arrived in the US.  She was living outside the country and hadn't even started this process yet".  Then I asked her to check the I94 to confirm my story.  She spent a min or 2 and concurred with my explanation.  She said that under this circumstance, a USCIS GC error is automatically approved to be expedited.

 

She said we will get a letter in a week with details about the expedite process.  Initially she said lets wait 60 days- but after she decided to expedite it, she said I shouldn't wait 60 days for an update and to email them through the USCIS account we have for another update.  I'd make the call if I were you!  Just try to get transferred to Tier 2 support.

Thank you Chritopher! This is really helpful. I have an infopass appointment to go talk to them on August 14th. It's good to know that they can in fact expedite fixing the green card when it's clearly an USCIS error. I'm glad they gave you answers! Thanks again for updating me. Please let me know!  Sounds good.  I tried for a long time to get an info-pass appointment, but every time I check it says that one is not available.  Pretty frustrating.

I know their system is weird. What works for me is going to their website really early in the morning, this was recommended to me by an officer actually. Seattle time before 8 am. That's when appointments become available for some day in the following next two weeks. Click on each date of those two weeks to see which one has available spots!
