I didn't think it was; I didn't recall coming across any age requirements when filling ours out. I'm not sure if they could make a denial/approval decision based on that fact, though. Of course, for the sake of being candid; at the rate it's taking them to even review applications (6 to 7 months average), she may be 18 by the time they'd even look at their application, if they were to file now.

I did read about age for the petitioner, in RapidVisa (if I'm not mistaken).

They can submit the petition now if they want. Yeah, it takes 6-7 months now. Mine is more than 6 months for NOA2, now over a month for the case number (still waiting). It looks like it takes forever now

Rapid Visa should be avoided, totally messed up a VJ member.

If the beneficiary is not over the age of consent then does she meet the "free to marry" requirement?

She would not....and that age to marry without parental or court approval is 18 in most states.....more in a few.....i think filing before that time would be cause for questions by US IS. And/or the Interviewing CO.

My thoughts exactly.  The petition should never get past the USCIS and be denied on those merits alone

YMMV

just want to know, is there any requirement stated that beneficiary should be at age 18 when they submitted the petition?

We have a Swedish girl in our AOS thread who received her K-1 visa before her 18th birthday (with her parents approving it). So it's not necessary to be 18 to file for the visa, or to actually receive the visa. Also meaning the beneficiary doesn't have to be 18 for the petition either.

Don't know about the petitioner though.

I doubt USCIS allows children to enter the US for the purpose of marriage.

Hello! I'm currently 17, and my fiance is waiting for me to turn 18 to send in the petition. My birthday's on the 23rd of December, however, we both want to be with each other as soon as possible. Do you think he should send it in on my birthday itself or is it possible to send it on the 22nd, hoping that it reaches by/after the 23rd?

Laws against child marriage

The age of marriage in the United States is 18, with the exception of Nebraska (19) and Mississippi (21). Every state allows exceptions to their age of marriage. Most states allow marriage at 16 and 17 with parental consent, and some states also make exceptions subject to judicial approval, or cases of pregnancy. When all exceptions are taken into account, 25 US states[4] have no minimum age requirement.[5][6] Twenty-five of the jurisdictions have a minimum age in these cases, the youngest being 13 (New Hampshire, females only).[7][6]

Unfortunately that's the case now :( Our NOA2 took a little over 6 months to receive, and now NVC is apparently taking longer than usual. :|

That's what my thoughts were - there may have to be parental consent/support. Based on her original post, I don't think the petitioner is underage.

And unrelated side note: Seeing another Swede on here made me smile!! :D

I was 17 years old when I sent in my petition. I wrote in my declaration when I would turn 18. My lawyer did research and said it was fine just make sure to include it. :)

since it is now after 2017 are you talking about 2018 december?

before you do anything check the USCIS or this site to see if you meet all citeria

Have you met in person?

Can you support and meet the financial issues / you need to make 100% for K1 and when you AOS after marriage you need 125 % of poverty guideline amount (for 2017 that was $20400 for 2 people)

also check all the fees

application for K1

application for visa processing

AOS fee

medical exam for beneficary

the travel to meet

this is not a cheap process / the estimated cost i now see online is about $5000

and truth is the visa can be denied after all the work you have done

If you can not support. I heard you can get affidavit of support when do you need to fill that out? Thanks!

OP- your fiancee isn't named Roy Moore by any chance is he? Sorry, had to make that lame joke.

Just wondering, have you been to semi-rural parts of the US before? I can't imagine moving from Singapore to a small city in AL. Each to his/her own, but love does NOT conquer all IMO.
