Can a Joint sponsor use household member income to sponsor me?

Hello all,

Our I130 just got approved and I am trying to get everything ready and  study the affidavit of support deal.

 

Here is our situation:

 My petitioner (USC husband) is living abroad with me. He is under job contract here until its time for us to move back. So his US income will be $0. He maintains US bank account drivers license and all that to prove domicile.

His parents are going to be our joint sponsor. His mother works (her income is under the 125%) and his father is a US army Veteran with pension and other monthly gov checks (not sure what). So their income combined will be above the 125% poverty line for household of 3 (his mother, father and me).

 

Our initial plan was to have my husband fill out I864 with his $0 income. And His mother as the main joint sponsor (filling out I864) and his father filling out (I864a).

Is this possible? or the joint sponsor can not use their household income? Read somewhere that the joint sponsor income has to qualified oh his/her own?

 

Please help.

your husband must file the i864 as he is the main sponsor, and attach a letter explaining why he hasn't filed taxes or if he wasn't qualified to do so

 

his mom will be his joint sponsor, and her husband her household member

HI, my fiancé  also worked abroad for three years. He declared his taxes from his income and it was still above the minimum requirements so they said its fine. Also, collect bank statements if he has been sending his money to the USA account , his work contract, and any retirement funds he has can be used.

Cool,thanks. One more, the new tax year just started. Should we wait until 2017 tax transcript available,(it'll take 6-8 weeks after paper submission) or just submit 2016 tax transcripts? And maybe 2017 1040 return+w2...?

I think we can't use his income abroad because whenever we move the income will stop.thats why we need a joint sponsor.

the 2017 tax will only be required after the tax season is over, after April 15th  depending on when he has to send the affidavit of support, he might or might not have to send it

Right. So I guess if we're ready to send everything before April 15th then we'll just send 2016 transcripts. And have 2017 transcript ready if the consular wants it during interview. Thanks a lot.

as long as he declared, and has over the income requirements for the past year or whatever it is, he should be fine. We use RapidVisa and when we filled out the income and forms it said "you do not need a co-sponser" plus it goes on the current income if he's back in the states by the time you need to prove the income
