I had an extremely xenophobic coworker three years ago who accused me of a various things and claimed to have called immigration to try and have me deported (as she was afraid I was going to take her job). This person did not file a complaint with our employer about me. I’m concerned that they’ll somehow reach this person and that it will affect my application. Any ideas what they ask?

Only if there's an apparent discrepancy, the I.O. would dig deeper.

 

For what it's worth, this "calling immigration and getting someone deported" isn't even good enough for a very, very bad Disney movie. We have an estimated 12 million illegal aliens in the United States, perhaps millions more, plus a few million visa overstayers. Do you really think we could not find those folks if we wanted to? On the same token, do you think ICE is waiting for a phone call from some Schmuck, complaining about a Green Card holder, for them to get out of their chairs and rush to the white van, visiting, interrogating, and then deporting you? If so, I have a great business proposition for you . . .

Indeed, but it doesn’t make it any less worrying when some A Hole claims they kept calling USCIS until they found a sympathetic immigration officer who gave this person my personal information. I have a lawyer at present and I’m waiting for my FOIA documents to come back to see if anything shows up, then decide who to sue based on that.

Keyword there is "claims".

 

 IOs do not give out any personal information except to the applicant themselves, and even then, they more confirm personal information rather than share anything the applicant doesn't already know themselves (because IOs know that anyone can say "I'm so-and-so" over the phone).  USCIS won't even talk to a person about their application in even the GENERAL sense unless confirming the person's alien number, full name, date of birth, application receipt number, etc. first.  Not to mention that once a request to speak to an IO is transferred, the IOs will call back the confirmed phone number associated with the original applicant only.

 

This person is just trying to get into your head with their own lies to garner a reaction from you, and they are succeeding.

My FOIA disc will be with me 15 days and I’ll post the outcome of my situation then. I hope you are right and I’m paranoid. The individual felt confident enough in her efforts to actually tell me what the IO had told her and even updated me with her progress (this incident took place two years ago). To tell me that she’s done enough damage to stop me from having my green card renewed. Again I hope you are right, but I don’t think it’s impossibly for someone to find a IO who doesn’t like foreigners regardless of how they entered the country.

The phone calls are recorded, if that makes you feel any better, so while I agree there may be an IO who doesn't like foreigners, there's the higher probability that those IOs aren't going to want to put their jobs on the line either by disclosing personal information to someone other than the applicant.

 

There is no way a simple phone call could result in your legal status being revoked.  The only one who can revoke your status is a formal Immigration Judge during a formal Immigration Hearing, and with concrete evidence submitted (not just going off of what someone claims/thinks/etc.).  I know it's stressful, and I'm not discounting you as just "being paranoid" because the immigration process is stressful enough without thinking there's an outside influence to your N400 approval/denial.

 

I would strongly encourage you to keep a calmer mind during this process, and to not let this person rent so much space in your head where it's driving you sick with worry and grief.  Because that's exactly what they wanted to do to you.

So amazing my FOIA disc arrived in just six days. It contained 294 pages of bland information about my migration to the US. They copy literally everything. There is nothing ominous in the files, however the cover letter included with the disc suggests there might be something on my file. Please read it and let me know if you think the content is normal. It says they are withhold 27 pages 5 of which were sent to the state department.

It's normal for USCIS to withhold entire pages or redact information in an FOIA request.  Usually it's pages filled with immigration officers and staff full names/work address/identifying badge numbers/etc. to protect their privacy.  It's up to the State department whether they release that info to you (they won't, by the way).

Why are you worried about your coworker reaching out to USCIS?  Applications aren't impacted by gossips and false allegations.

The person in question was telling me sensitive (and correct) information about myself after claiming they had spoken to immigration about me.

 

i also visited USCIS who told me there were entries in my file that they removed after I informed them what had happened. 

 

Hence my state of concern.

Oh man I am sorry to hear that. These kind of things can be really stressful. However, since you didn't do anything wrong, you have absolutely nothing to worry about. Good luck!
