Hello!

 

I am recently married to an American lady and we are putting the finishing touches to the AOS package. (I'm here on an O1 visa - almost 3 years)

 

Do I have to put my UK assets down on the I-864 form (in PART 7, section 6) OR do I just put my current US bank balance? 

TBH - I dont have any money back in the UK these days as I've transferred my life over here, so it would be pointless.

 

ALSO -  Will my earnings effect the case...can't I just leave it blank?

The form is for your wife to fill out, not you. If she makes enough in salary, then no assets have to be listed on the form. They approve on current salary alone. If she needs a boost to her income because it is not enough, then I suggest you go to the instructions for the form and read 

 

Part 5. Item Number 3. - 17. Current Annual Household Income.  

Part 7. Use of Assets to Supplement Income (Optional) 

Item Numbers 6. - 9. Assets of the Intending Immigrant.

If she needs to show your income as part of "household income" just to get her over the required threshold, then be sure and include documentation of what allows you to be earning money in the US with the I-864 form. Your visa that shows it is legal for you to be working in the US should be included with your income proof or they will RFE for it.

 

If she makes plenty on her own, then nothing required from you.
