Hello, 

 

happy new year everyone! So I know that there is already a lot of threads regarding this matter but most of

I read is they have compounded a lot of evidences (loans, credit cards, billing statements, lease agreement etc.) 

 

We are filing soon (maybe around feb.), but I'm a little bit concern that I may not have a lot of 'evidence' because I don't have those examples above. (I am the alien spouse) 

 

at the top of my head, (hypothetically, if we are going to file now) all I have is..\:

1.) taxes filed (from the date of marriage) 

2.)  joint account statements from our bank  

3.) TONS of photos. ( 2nd wedding in the Philippines, travel) 

4.) affidavits from friends and relatives. 

 

NOTES: We keep our finances separate like credit cards, bills etc. that works with us.
We live with other people so like our other bills (internet, electric etc) doesn't reflect our names in it. 

 

Do you think these might be enough? I'm so worried.

Send what you have; explain what you don’t have. Write a cover letter that explains what you are including and describes your situation and how you manage your finances. 

If you don’t have a lease or utilities in your names you can write a document that lays out your arrangement with your roommates and have all of you sign it. That should cover that part of it. 

 

You can also create wills and powers of attorney for free online.

 

Are you on the same healthcare plan? If yes, include evidence of that.

 

Do your state ids have the same address on them? If so, send copies of those.

Google is your friend.  Every state has slightly different rules.  In Colorado you can write a will on a piece of scrap paper, if its notarized with a witness  thats better.

It costs a little bit of money, maybe $60?  But legal zoom does wills online.  My dad did his will through there and it did hold up through the probate process.  Something to consider if you are thinking about the future with it, versus just using it as evidence for ROC.  At least in my state and others, it is a good idea to have a self-proving affidavit with the will so that the witnesses don't need to be called to the courthouse after the person dies.
