Hello every body

iam an unemployed American wife petitioning my hasband,,, I never worked before ,so I am going to have a joint sponsor for my hasband.... 

now.. on  my affidavit of support (me the principle petitioner).. what should I do regarding the  tax returns?

is it true that unemployed person should file  taxes any way...

 Iam not getting any unemployment assistance.

 Do I have to state that I don’t file taxes and write an explanation on that.

From my understanding the petitioner must have some sort of income to be able to show they can contribute to the financial responsibility of the person they are sponsoring in addition to your co-sponsor. VJ'ers????

You are required to submit the I-864 since you are the petitioner. You must submit at least the most recent year's tax return (with 2 years prior to that one being optional). If you did not file and were not required to have filed taxes (i.e. due to no income), then you would write a letter stating this in lieu of the tax return(s).

 

Whether or not you were required to file taxes depends on your circumstances.

 

I'm assuming you are using a joint sponsor to meet the financial requirements, right? Or assets instead of income?

well,, i  do have assets.. but their value is  below the 3×125%poverty line so ...i would need a  joint sponsor to meet the requirments.

yes i now this..but this for someone who is employed.. but  what about someone who is unemployed. still need to file?

Being employed or not isn't really the issue for taxes. Somebody can be unemployed and still need to file if they have income or otherwise a tax liability. The vast majority of people who are unemployed the entire year won't need to file, but there are some circumstances where a person would need to file (i.e. if unemployment compensation from a previous year carried over, lots of taxable interest or dividends, withdrawals/disbursements from a retirement plan, etc.).

 

The I-864 still needs to be filed either way.

Not correct.  However, decisions on the public charge issue are judgment calls.  It is possible to deny the visa if the Consular Officer believes there is reason to think the intending immigrant cannot support themselves or will not be supported by the sponsor.  They will consider the totality of circumstances when making this decision.  Chances are that unless the intending immigrant has a good employment history of their own and appears to be imminently employable, even a joint sponsor would be rejected.  (Unless the joint sponsor has a compelling reason to ACTUALLY support the intending immigrant.)

 

The petitioner would state their current income as zero an can simply hand write the following words in the available area on the form.  "Not required to file.  Income below threshold."

People can absolutely be exempt from filing if they don't have an income to report. 

 

Just double check IRS exempt guidelines and as stated above, write you were exempt per IRS regulations. 

 

You are exempt if your reportable income is less than the year's standard deduction.
