Got a couple of fakeouts today.

 

First, a letter from Senator John Cornyn's office following my recent griping to him (and Ted Cruz, and my Rep, Mike Conaway) about the disproportionately long processing times at Dallas.

 

I was surprised not to receive a form reply from John Cornyn, which I did receive from Mike Conaway. In its entirety:

 

"Thank you for your recent letter. The United States Citizenship and Immigration Services (USCIS) has advised me that, due to the tremendous number of applications they have pending, there is a delay in processing and you will be advised when your petition is current.

 

The USCIS is currently processing applications for your category that were filed on or before January 1, 2017. Unfortunately there are no provisions under the law to modify or change legal requirements to benefit a particular case. If your case was filed at a USCIS service center, you may monitor the status of your case online at http://bla

 

I appreciate the opportunity to represent you".

 

So what I expected, for the most part. It probably even sounds dumb to most people that I would even send something like this, and to Republicans too, for whom immigrants are not exactly a top priority right now (other than trying to get rid of them and make life harder). But I do believe that fundamentally we (all of us) deserve an immigration system that benefits us all equally. There should be no patchwork of someone whooshing through the process because they happen to live in an area with 5 people and a cow, while others who live in major metropolitan areas sit at 1 year+. Regardless, nothing will change based solely on what I think, but this is a democracy and my representatives are lucky enough to receive my thoughts - whether they want them or not.

 

Oh, and I said there were two things. The other thing was that the app I use to monitor my case showed an update... but it turned out to only be an update to a case adjacent to mine, not actually my own. But perhaps that's a good thing; maybe they're getting close to me. Based on timelines from other Dallas filers who filed at the end of last year, I may hear something by the end of next month. And that would be great. At least lots of others here are getting movement, and that's a good thing.

First, a letter from Senator John Cornyn's office following my recent griping to him (and Ted Cruz, and my Rep, Mike Conaway) about the disproportionately long processing times at Dallas.

So what I expected, for the most part. It probably even sounds dumb to most people that I would even send something like this, and to Republicans too, for whom immigrants are not exactly a top priority right now (other than trying to get rid of them and make life harder). But I do believe that fundamentally we (all of us) deserve an immigration system that benefits us all equally. There should be no patchwork of someone whooshing through the process because they happen to live in an area with 5 people and a cow, while others who live in major metropolitan areas sit at 1 year+. Regardless, nothing will change based solely on what I think, but this is a democracy and my representatives are lucky enough to receive my thoughts - whether they want them or not.

 

Oh, and I said there were two things. The other thing was that the app I use to monitor my case showed an update... but it turned out to only be an update to a case adjacent to mine, not actually my own. But perhaps that's a good thing; maybe they're getting close to me. Based on timelines from other Dallas filers who filed at the end of last year, I may hear something by the end of next month. And that would be great. At least lots of others here are getting movement, and that's a good thing.

@Hypnos, I totally understand your frustration! According to the table, the majority of us have waited the same as you (and who knows how many more people are going through this without using VJ). However, I think it's unfair to think that it's not benefiting us equally.

 

As I understand, immigration cases don't work on a first-come-first-serve basis; the main reason why is that people are applying under the 3-year rule, some under the 5-year rule; some of us are over 18 but under 26, seniors, disabled and a large etcetera (https://www.uscis.gov/sites/default/files/USCIS/Resources/Citizenship & Naturalization Based Resources/A Guide to Naturalization/PDFs/M-480.pdf), so the pool is way more nuanced than we think. Furthermore, the cases seem to also be considered based on our local office (the number of applications that they receive) plus the country we are coming from, not when our application was submitted. To put it in context, Mexicans amount to 13% of the naturalization applications and North/Central America and the Caribbean amount to 34.5 of all naturalization cases (source). If this was worked on in a first-come-first-serve basis, your case would be way behind just by simple math (UK: 1.3% [#1 for Europe]; Europe: 9.9% - see last source) and I'd already be a citizen. Plus, I don't see where the assumption of people living in an area with 5 people and a cow holds up - would you mind pointing me to it?

 

Sadly this is not fast, but no one told us it would be. Clearly, the current administration, and other obstacles to naturalization have created delays and red tape around the whole process. Like you, I live in an area with a LARGE immigrant population;  you and I are from the #1 countries that apply for naturalization in our regions USCIS-wide and therefore we are in line, in our queue per region, per country, per field office, apparently. ¯\_(ツ)_/¯

It's my understanding that in general, USCIS does process cases in the order they are received. And for naturalisation, your country of current citizenship is not a factor when it comes to how long your N-400 will take to process. 

 

Clearly my comment about five people and a cow was hyperbole, though the idea behind it is not. It's simply a fact that some people live in areas with much smaller workloads at their local office, meaning shorter processing times for them, and some people don't have that luxury. I would argue that under the idea that "justice delayed is justice denied", this does cause very real harm to some individuals just by virtue of the fact that they happen to live in a more backlogged area, as seems to be the case for us. 

 

As I've said before, I require US citizenship for my chosen career field, and can literally do nothing towards it until I am a US citizen. There are people who have submitted their applications after me, both on VJ and other places, who are already finished with the process.

 

I don't mean this to sound like whining (though I guess I am), but it's more related to some of USCIS' (many) shortcomings. Honestly, a root and branch evaluation of the entire American immigration system is required, but we're not going to get that anytime soon. 

 

I just disagree with their principle that how long your applications take to process should be largely dependent on your zip code. You're certainly correct to say there are other factors involved, but where you live seems to be the biggest one, and I don't think that's fair. As I've said before, that wouldn't fly for other federal services, so I'm not sure why it is for immigration. Imagine seeing such disparities in the processing times for social security cards, or US passports. You'd have people marching in the streets if you said that some of them get their social security cards in a couple of weeks and others six months. 

 

So yes, I'm frustrated, and I'm very aware many others are experiencing the same frustration. I'm trying not to make it all about me, but while the federal government does do a few things right, how they approach immigration is not one of them.

Move to Vermont.  If you can't beat them, join them.

Yes, it is really frustrating to receive email saying "We are still reviewing your case and there are no updates at this time" in the early Saturday morning every 2 weeks. I guess a problem is that the USCIS is operated ~99% by fees (not tax money) and most of taxpayers, US citizens and lawmakers don’t care what the USCIS is doing. Majority of the US citizens don’t marry a foreigner, they don’t make a petition for green card of their parents, children, or brothers/sisters. One-year waiting is much shorter than my I-140/I-485 (1.5 yr, EB2 for me) and I-130 (4 yr, F2A for my wife) cases. Should I be patient a little longer?  (T_T)

I totally agree with this as it's clearly mentioned in USCIS website, and that is apparently why the (estimated processing time invention) created for.

USCIS established the new system to apply for N-400 late in 2017, beside it's too late for them to use the available online technology, they didn't have an ideal plan to maintain the balance between paper filer and online filers, which caused a lot of backlog and longer waiting time for paper applications. On the other side, the system wasn't implemented properly, and that's obviously shown (at the same field office) in cases that have been picked for interview within a couple of days after fingerprint vs. cases that have been in waiting for several months.

Sadly this is not fast, but no one told us it would be. Clearly, the current administration, and other obstacles to naturalization have created delays and red tape around the whole process. Like you, I live in an area with a LARGE immigrant population;  you and I are from the #1 countries that apply for naturalization in our regions USCIS-wide and therefore we are in line, in our queue per region, per country, per field office, apparently. ¯\_(ツ)_/¯

Sorry if I disagree with you, but immigration cases definitely work based on a first-come first-serve rule,

The fact of the different categories (3-years, 5-years, seniors, disabled, etc.) is they are only qualifications to apply for naturalization due to certain requirements for each category. Once you become qualified to apply, it's first-come first-serve.
