One Year Since Status I-485 Changed

Hi,

 

I'm getting a bit nervous about my husband's change of status approval.

We filled back in November 2016. Everything went smoothly until the interview.

 

The interviewer thought his biometrics were incomplete however, she failed to realize that part of his shots were done in the Dominican Republic so he only needed a few missing vaccines done in order for a completed biometrics. When we returned to the office, she told me that she would have her supervisor review all the records. Our interview was back in July 2017.

 

I don't mind waiting but I see his work visa will expire in 3 months. 

 

Questions

1) Is this normal to wait a year for a change of status?

2) What should I do if we reach his working visa expiration? And should I get a head start on this?

3) Why is his receipt status not changing? It keeps saying his fingerprints were received and when I call, no one is able to give me a status.

 

Basically the interviewer was confusing herself and I'm afraid it has hurt out timeline. Otherwise, the interview seemed to have gone very well and she did leave off saying they would need to conduct a background check (another one).

Timeline

Did you file for employment authorization along with the AOS? If not, I think you can still do it now so he can start working even if he hasn't received his green card yet.

05/24/2017 Entered the US on a J1 visa

10/10/2017 We got married!

10/27/2017 AOS Package sent via USPS - Chicago Lockbox

10/30/2017 Package delivered 

10/31/2017 Priority Date

11/07/2017 Received email and text notifications about all 4 forms

11/14/2017 Received hard copies of all 4 NOAs

11/21/2017 Received biometrics appointment notice scheduled for 11/29

12/15/2017 Interview notice - interview is scheduled for January 19th! Holy #$%^ that's less than 3 months from PD!

01/02/2018 EAD + AP approved

01/16/2018 Combo card delivered

01/19/2018 Interview - recommended for approval

01/22/2018 New card is being produced :dance:

Hello, Yes we applied for an I-765 which is valid through March 2018. That's why i'm worried.

The employment authorization is valid for only a year, we thought this would hold us long enough until his change of status was approved.

 

We're in New York City and I'm just wondering if it's typical to have to wait this long. :(

You can file I-765 again within 90 days before the current EAD expires for free.
