First of all, work is sourced where it is performed.

So it depends on your work/job/business.

If it's an import/export business, for instance, it could be sourced in the UK (regardless of where you are).

But if you provide any sort of personal services (that means any consulting), then it is sourced where you are located when you actually perform. So if you just send a work email with a bit of consulting from the US, that is considered US-sourced income. This is at least what tax laws say (de minimis exceptions apply).

With ESTA there is of course a sort of pre clearance and they get the manifests so I can quite see someone boarding in the UK being turned away.

 

 

Heathrow and Gatwick are on the list of potential future pre-clearance sites but that has not yet been implemented.  They may be in some sort of pilot testing it however and that is what occurred

Just curious how the pre-clearance would work (I haven't flown from Canada in over 8 years and don't remember).

Just for immigration purposes or Customs as well?

If the latter, the flight might just be treated as a domestic flight once it gets to the US.

Exactly, a pre-cleared flight does not have to disembark at the international arrival terminal and can proceed directly to a "normal" or domestic gate

So you clear US customs as well when departing?

I remember clearing US immigration at Montreal airport, but don't remember US customs...

I flew back via LHR in July, I don’t remember anything “extra”?

By the way, there is some sort of pre-clearance (not CBP though) in Milan, Paris and other major airports in ESTA countries.

I fly most of the time in/out of Milan Malpensa and before you even get to check your bags, you have to go through a desk where they electronically check your status (I presume ESTA). I always get asked because I clearly look and speak Italian, but then I show them my US passport. Once I tried and gave them my Italian passport and they were puzzled and asked me for a green card (since I had no return ticket).

I don't know whether they are retained by US authorities or the airline. I presume the airline since they are responsible for the cost of flying back a person who is denied entry (and I think they get fined too, if there is a clear lack of documentation at boarding).

That's just the airline making sure you have the correct documents to enter your destination country, not pre-clearance.

Definitely not CBP, I know. But not airline or airport employees either. They are a third party. And only for US-bound flights.

I remember clearing US immigration at Montreal airport, but don't remember US customs... My pre-clearance experience, Montreal into a domestic US airport, we had both Immi and Customs at YUL; fill out Customs declaration, bags may\may not be opened.

I figured that OP found a good flight from one of the Irish pre-clearance airports and then took Ryanair or something to get there. When getting on in UK, they wouldn't even know he was US bound and the CBP in Ireland would notice the more than 90 day plans. People do this inside the US all the time, use a domestic airline (often Southwest) or possibly a voucher from a previously cancelled flight to position themselves in a strategic airport to get a better international fare (Miami if going to Central/South America, New York/Boston if going to Europe, LAX or San Francisco if going to Asia etc), or just to an airport that the airline happened to have a sale from. It can be much cheaper.

December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:
