Not just overstays, denied entry can result in ESTA revocation as well

I read reports of people, that had similar situations. They reported that after 2 years of time, ESTA applications worked again.

There seems to be a re-set, at least for some. B Visa will be faster.

 

As far as I know, only Ireland has CBP officers at the departure? Did you fly via Ireland or they added now CBP also to London airports?

Ah well then good luck! I don't see you getting a b2 anytime soon as you showed intent to overstay. I really think that you need to make plans to travel elsewhere. Maybe in a year you can give it a shot but I would assume your success rate will be low.

I do own a business.   What qualifies as large cash reserves tied up?    Does this really make a difference?  Bank transfers between the UK and the US are pretty easy.

You need to strengthen your ties to your home country. Unfortunately being self employed hurts your chances. You need to have a real job, a rent under your name, everything else is secondary and risky compared to those two. 

 

You lost your ESTA forever. Why would you buy a return ticket for more than 90 days when you know that’s the most you can stay? That was a stupid move and you now suffer consequences. Anything you try now without proving strong ties will just be seen as someone who’s trying to abuse the system and immigrate on a tourist visa. You will most certainly get denied.

I mean a business that you need to be on-site to run, not mobile-- the mobile part would be working against you in this situation.  Large would be tens of thousands of dollars-- transfers of that size are not easy. There may additionally be some kind of annual limit but I really don't know. I do know that the cash tied up abroad is supposed to help show close ties. However if rules are different for UK citizens, then that's an option gone as well. 

 

They really just need to see proof that you have more reason to go back (or, rather, to LEAVE-- if you were set up with legal residency and ties to some other country, that could help) than to stay. The legal assumption is that you are planning to stay. So while the explanation of being a digital nomad is a reasonable one and more believable than many stories about visit visas we get here, it's just not in line with how they *have to* make their decisions about you. I know it's frustrating (went through this with my now husband who never even had the luxury of ESTA) but this is just the reality of visit visas for most highly developed/wealthy countries-- UK included. We (I include myself in this), people from these countries are just so used to being able to go where we want when we want, we often fail to realize that borders aren't actually open....and usually don't learn that lesson until we're struggling to maintain an international relationship with someone from not as privileged position, or until we've made a mistake and learned the hard way. 

 

All that said, it is certainly worth a try, I just think people are trying to tell you it may be difficult and they're probably right-- you just won't know until you try. There are a lot of fun and interesting places to travel to/work remotely from-- US wouldn't even rate on my Top 10 list of best places for a digital nomad and I do actually like it here.

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Except a step out to Mexico would not have reset the 90 day clock.  The step out would have to have been outside the WHTI

If you're not in any  hurry to travel to the USA, again I would suggest waiting at least 6 months to a year before applying for a visa.

 

The reason I suggest this is two-fold:

 

1)  Gives you time inbetween losing the ESTA and applying for the visa (which will make you appear less desperate in the eyes of the CO to enter the US)

2)  Gives you time to build those ties to the UK that the CO is going to want to see.

Unless you live in a country with exchange control, it’s pretty easy to transfer even a large amount of money. A few forms. Not a tie.

With my Bank anything over GBP10,000 and you need to go through an extra process, but otherwise less than a minute.

A simple US Treasury form, nothing too onerous as long as funds are 'clean'.
