Hello all,

 

My wife's (Alien applying for AOS) interview for AOS is coming up in a month, and the NoA provides a list of things to bring with us to the interview. A few of these I wasn't sure about and wanted to make doubly sure.

 

1. "A completed medical examination (Form I-693) and vaccination supplement in a sealed envelope (unless already submitted)."

- I'm assuming the one my wife had from the K1 Visa would suffice. Do we need to do this again?

 

2. "A completed Affidavit(s) of Support (Form I-864) with all required evidence, including the following for each of your sponsors (unless already submitted):"

2a.  Federal Income Tax (W-2s)..for the most recent tax year;

2b.  Employer stubs, etc.

2c.  Sponsor's citizen ship

- The wording "unless already submitted" confuses me. We already submitted with our I-485 application. Now that it's 2018, as the Sponsor, would I need to bring my 2017 W-2s and the pay stubs? Or is what we provided for the I-485 good enough?

 

3.  Birth certificates.

- Do they need originals or just copies of them? I'm assuming copies since that is what we submitted before.

1. I'm pretty sure the medical your wife did in her country for the K-1 visa is good for 1 year. So if your interview is within 1 year of having that medical, you're not required to bring it. (I didn't bring mine).

 

2. I brought i-864 to the interview + evidence but they didn't look at it. My interview was on the 2nd of Jan so we hadn't gotten W-2's for 2017 yet, neither at the time of filing i-485 and not at the time of the interview. Was no problem.

If you filed your AOS correctly (that is, included a I-864), I'm 90% sure you don't need one. But for peace of mind you might want to bring one anyway. A few extra pages won't hurt, even if it's not needed.

 

3. We brought originals and copies as per their instructions. They did not keep the originals. 

 

We took the "Lets go the extra mile and always bring/submit more than required, for our peace of mind at least"-approach all the way through the process, it served us pretty well.

2) If already submitted then 2a,b,c are N/A

3) Original certified copies, you submitted photocopies previously.  They will compare and provide them back to you

Hi, I'll have my interview this month as well.

 

Like Skatie I'll bring everything just for the peace of mind,

but the W's for 2017 might be a problem since my interview will be on january 23.

How soon can I apply for it and when will they send it? It may not arrive in time. Will it be a problem?

 

They are also asking for employment certificates and pay stubs for the past 2 months. I think you should bring those even if you "already submitted".

Thanks for the inputs:

 

1. It has been over a year since she did her medical exam in her country. We have copies of the paperwork, but my concern is whether she would need to redo the medical exam or need to have the results sealed. I'm hoping the "unless already submitted" part means that since it was done as part of the K1 visa that we don't need to redo the exam. Sounds like we might be okay though...

 

2.  Yeah, I think I'll bring whatever I might have at the time. Better safe than sorry on this. Plus, it's easy to bring this.

 

3.  Originals would be tough for my wife. Hers is still in her native country. We just had copies that her father sent. I do have mine that I could bring. Do you think this would be a big deal?

W-2s come whenever your employer send them to you. Some companies will have it online for you to download or print out. I agree that we should bring the pay stubs. That's easy for me to get and definitely a safer bet.

Hi Bernie -- 

 

First, Congratulations & Good luck to you and your wife. I had my AOS interview (adjusting from K1) in Los Angeles last month. 

 

Q1: I didn't submit I-693 as the health / vaccination document form (DS-3025 ) performed during my K-1 Visa application was still valid (i.e. within the 1 year period of my AOS). I submitted the 'Applicant Copy' of DS-3025 (signed as COMPLETE by US Embassy appointed the panel of physicians)  and also the vaccination record in my AOS Application pack. During my interview, I was even asked about anything related to vaccine / health check by the officer. 

 

Q2: I did not submit any new / additional documents from my husband (Primary Sponsor) and our Joint Sponsor. Because ALL of these documents were submitted in my AOS along with my AOS Application Pack in August 2017. NOTE: My interview was in December 2017. And based on my interview the officer didn't even ask / mention anything related to finance / tax documents. 

 

Q3: They will ask TO SEE the original birth certificate from each of you (the USC / Petitioner and the Beneficiary). They might want to keep a copy of these birth certificates but they will ask and verify with you before they keep a copy whether it's OK for them to keep a copy (I am assuming this is to ensure that they did not take the original copy). My advice is to ALWAYS have both the original and copy of these documents. 

 

From my experience, here are things that I would like to pass to you: 

 

1. Bring a copy EVERYTHING (as in EVERYTHING) that you and your spouse have ever submitted for your case. If your wife came to the US with a K1 visa then you would want to bring the: 

  • COPY of all the documents you (and your wife) submitted for your I-129F Petition
  • COPY of all the documents you (and your wife) submitted for your wife's K-1 Visa interview
  • COPY of all the documents you (and your wife) submitted for your wife's AOS, (and EAD, AP if applicable for your case)

Why do I think this is necessary? because in my particular case, the officer who interviewed me and my husband did not have a copy of our I-129F and asked us "Where are all your old photos?" so I gave her a copy of the photo booklet we submitted along with our I-129F back in 2016. 

 

2. Your officer (the person who will be interviewing you and your wife) MIGHT  not be familiar at all with your case / documents and they also MIGHT not be given all the documents you ever submitted. This is why I suggest bring everything ever submitted for your case. Our officer didn't have the approved I-129F Form for our case (which I have a copy given during my K-1 Interview). But she explained that she cannot accept a copy of this particular document from the applicant, she must obtain this document from the 'System'. 

 

3. You MIGHT not get the final approval / Green Card approval by the end of your interview. Missing documents might cause this. This happened to us. Our officer explained about the missing I-129F but she said it's not our fault it's basically bad organization on their part. She advised not to overthink / stressed over this inconclusive interview and that we will hear from her witihn the next three weeks.

  • Our interview was on 11 December 2017;
  • Conratulatory Notice (white sheet) dated 26 December 2017 arrived via mail on 29 December 2017;
  • Actual Green Card arrived via mail on 30 December; and
  • Official Approval Notice arrived 2 January 2018.

The officer was not joking when she said that we will hear back within the next three weeks. 

 

BONUS: Our officer was SUPER kind, pleasant and was not, at all, intimidating. I read storied here where people say that their interviewere was intimidating. This was not the case of me and my husband. She was actually very friendly. 

 

Aside from that, GOOD LUCK!! HAVE FUN!!! and this is me being an old caring father, "Eat before the interview because once you checked in for your interview you'll be waiting for a long while. Also, wear something proper and nice."
