Has anyone that is applying for AOS dealt with their 2017 taxes yet? I'm at a complete loss on how to go about this. Tax guy says that if we file jointly, i have to file as a resident. Which is fine if we claim a foreign income exemption from income tax but he's also saying that we'd still be on the hook for social security and medicare taxes for that foreign income. Is this right?

 

Wondering if I should file at all since I really don't have to and just let my wife file "married filing separately" and be done with it.... Why is this so complicated?

I am still waiting on my RFE to actually to get to me and see what it is about.

01/19/2018: Checks cashed

01/22/2018: 3 NOA's received in Mail (I-130, I-485 and I-765)

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/12/2018: Early walk-in for Biometrics, successful

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

Well, I believe you can still file jointly and won't have to worry about any of that,  provided you are still unemployed here in the USA.  Your wife can file jointly based on her income alone. 

You need to have your SSN or ITIN number before you can file jointly tho.

My husband and i filed jointly even tho I had no income for 2017. I suggest you get a second opinion consult for your taxes.

I've read that it should come one to two weeks after we receive the EAD card if you requested one to be sent to you.

I know there's a thread about filing taxes in the first year after k1 but it's all too confusing.

Did any of you file as a “resident for tax purposes”? That’s what I was told was a requirement to file jointly. Did you have any foreign income in 2017? Did you then have to file a foreign income tax exemption on it?

 

I’ve tried reading through the forums but I keep seeing contradicting information.

Yes, I did. You get itin or if you ever traveled to the us on a particular visa you can use limited ssn if you have.

I have a SSN already, thats not the problem. The problem is that I'm being told that the foreign income exemption only covers an exemption from income tax. It does not exempt you from having to pay social security/medicare tax if you didn't pay similar tax already on income made in your home country. So filing jointly and as a tax resident would cost us money rather than save us money.

"You and your spouse are treated, for federal income tax purposes, as residents for all tax years that the choice is in effect. However, for Social Security and Medicare tax withholding purposes, the nonresident alien may still be treated as a nonresident alien."

So I don’t need to go to ssa after receiving ead card?

Thank you so much! I knew there had to be some way but my tax guy kept telling me different and I could not find a legitimate  source to prove it to him. 

 

I will show this to him in the morning and see what he says.
