They want us to submit the W2 for the ''most rest year'' which is 2017. I believe.

And it also states that based on the documents submitted with form i-864 that the sponsor didn't meet the 125% of the poverty guideline for our household size. We also need to refill page 4 of the for i-864 i.e the household size number section.

Yea, We know that my wife wasn't above poverty guideline in 2015/2016 because she was a student, but she started a full time job last year that got her well above the 125% poverty guideline, and we were able to file a joint tax that shows are recent earnings at her current job for the past 6months.   

So this is my concern, is sending the latest W2 and Tax transcript for year 2017 and 6months pay stub  enough to sort this problem. Or must we be above the poverty guideline for the past 3yrs?

Because we are above the guideline going by our current income.

 

I want to know what  you guys think and what  you advise we go by. 

And of course they suggest we get a joint sponsor which i think  will be difficult to come by at the moment .

Hi so I did a little research for you I was trying to include the link here but will try again later, anyways basically what i would suggest is to submit all the documents you listed as well as the letter from your wife's employment as evidence supporting your claim abt expected income for the current yr (employer address, phone number, beginning date of employment, type of work performed and annual salary) you can also include the value of assets or assests of other household member who has signed a I-864A. The best way to meet the requirements tho is through joint sponsorship but as u said that may be difficult to find. Good luck and keep us posted!! Praying that those documents will be enough

It's okay. Myself and a few others I knew from August and September forums have received RFIE 5 months after filing AOS. You being a January filer and receiving a RFIE so early is a sign that your file is indeed moving in the right processing time.

I am starting to get a bit worried because it is almost 30days and no biometrics letter appointment yet, the NOAs stated that my applications were transferred to the National Benefit center, from my little research, according to where I live it was sent to Baltimore which is pretty slow from what I read.

So either everything is fine and they are just slow or the letter was sent and maybe lost in the mail...

I signed up for Informed delivery, email notifications on the case status online and also have the USCIS app and t doesnt show any update.

 My husband thinks I am worried for nothing, but I thought I would ask just to get a 2nd opinion.

Expect biometrics mail atleast 30 days from receiving NOA1 mail. Please don't worry. 

Sometimes USCIS officers won't update the system. When i received a RFIE the update still said "We received your biometrics fees......" but only after i sent in requested documents back to USCIS that when the system update showed " Response To USCIS's Request For Evidence Was Received".

 

I'd say sit back and relax and you will definitely receive the biometrics mail very soon :)

You will have to be above the Poverty Guidelines depending on the year. If you have filed in 2017 then you will have to check the I-864P, HHS Poverty Guidelines for Affidavit of Support. 

 

Note: I-864P, HHS Poverty Guidelines for Affidavit of Support is not yet updated for 2018 so applicants can still use the 2017 version...https://www.uscis.gov/i-864p....Keep looking at the page because I guess they might change in March 2018 because it was last updated on 03/07/2017

I think i am gonna go by your suggestion.. and may be try to get a letter from her employer, hopefully we gonna get one soon coz it it usually takes 2weeks or more to get such a letter from her organization. i will go ahead and do more research to see what more could be done.

You're welcome!

It doesn't hurt to ask her employer, right? If they take too long, you could send the offer letter she got because it usually states how much she'd make per year, etc, right?

Thank you so much for  your effort @Stewt. i will see into how we can get the employer's letter although it takes a while to get that. btw! our 2017 shows that the income is way above the guideline ... "just trying to see if that means anything" you know

Your most welcome! If the 2017 annual income is way above then that should be enough along with recent pay stubs I wouldn't sweat it too much! Send what you have and see how it goes. At least that's what I would do!

oh yeah i think you are right . thats a perfect option .. i think we might just sen the job offer since it contains all the information they probably want.. we will request for the actual letter and if doesn't get here soon enough we will go by the job offer.

Sounds good to me. I don't see a reason they should want more or joint sponsor if she made above the poverty line for 2017. I think you only need it for one yr not 3

Received my biometrics schedule for 14th. I noticed that there’s only 2 application number indicated at the bottom part of the notice which is the ead and aos. I applied also for ap but i didn’t received yet the hard copy of noa1 for ap yet I received 3 noa’s email from uscis. Is it normal?

I think we belong here now? :) We filed for AOS (and EAD/AP) on Jan 29 and got a USCIS Acceptance Confirmation via e-mail/text  for all three forms on Feb 2. No hard copy NOA1s yet, but I am sure that might take a while. 

 

We did not include any medical documents as I was not given any (except for the vaccination sheet, which we did not include though) and we read if the medical took place within a year from filing, this is fine for K1. Can anyone here confirm or should we have sent something?
