January 2018 AOS Filers

No need to worry mate, I received my biometrics letter a week after my NOAs came through.

Dear January Filers Please Advise!

 

So, I've been in conversation with this production company for a few months now for an upcoming TV production(I work in the film industry.) They offered me a position end of last year. But I need to travel outside the US during the 6 months of production possibly March to September. We filed our AOS and my AP+EAD December 27th, biometrics appointment January 31st, expecting AP+EAD mid-March. The company is not US based, so EAD is not an issue. Plus I still have my EAD from my previous visa.

 

My concerns are:

1) If we are lucky, our interview may be scheduled during the time I'm abroad. In that case, we will have to reschedule the interview. But with the AP, can you be outside the US for over 6 months and come back to the US without a problem? Do I need to travel back to the US every 2-3 months to keep the time frame shorter?

 

2): If I can't come back to the US after 6 months of travel what should I do?

 

3): Will it be a red flag for the interview officer to see that I was away for so long? But the nature of my job is largely based on travel, 90% of the big gigs I get are not local. 

 

I'm very frustrated because this is one of the kind opportunity and, to be honest, I already gave up two very big gigs last year in order to get through all the immigration procedure. And in the film industry, everyone knows everyone, I'm afraid if I say no to too many gigs, people will stop asking... Plus, I haven't got any big gig for a long time.

 

What would you do in this situation???

Hi, all! Hope you're having a wonderful weekend and may the coming week be great to most, if not to all, of us!

 

I'm going to my biometrics appointment in Bellflower, CA tomorrow and hope everything will go smoothly. I was supposed to do an early walk-in last week but I got a deep cut on my pinkie after a little accident in the kitchen. Being a full-time housewife is NOT easy! Can't wait to get my EAD and start working. :P

I was worrying a bit too, but the letters arrived anyway:) As you can see from my signature, my NOA1 is almost the same as yours, and I only got the letters on Saturday. I'm sure yours are coming soon too.

Hello guys, anybody here living in Maryland please?

Here is my Timeline:

Priority date: Jan8th

3 NOAs received on Jan 22th dated Jan 18th

I am starting to get a bit worried because it is almost 30days and no biometrics letter appointment yet, the NOAs stated that my applications were transferred to the National Benefit center, from my little research, according to where I live it was sent to Baltimore which is pretty slow from what I read.

So either everything is fine and they are just slow or the letter was sent and maybe lost in the mail...

I signed up for Informed delivery, email notifications on the case status online and also have the USCIS app and t doesnt show any update.

 My husband thinks I am worried for nothing, but I thought I would ask just to get a 2nd opinion.

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

Hi Guys, So just as i had predicted, the RFE came in this afternoon and they are requesting for the exact things we have in mind.. 

They want us to submit the W2 for the ''most rest year'' which is 2017. I believe.

And it also states that based on the documents submitted with form i-864 that the sponsor didn't meet the 125% of the poverty guideline for our household size. We also need to refill page 4 of the for i-864 i.e the household size number section.

Yea, We know that my wife wasn't above poverty guideline in 2015/2016 because she was a student, but she started a full time job last year that got her well above the 125% poverty guideline, and we were able to file a joint tax that shows are recent earnings at her current job for the past 6months.   

So this is my concern, is sending the latest W2 and Tax transcript for year 2017 and 6months pay stub  enough to sort this problem. Or must we be above the poverty guideline for the past 3yrs?

Because we are above the guideline going by our current income.

 

I want to know what  you guys think and what  you advise we go by. 

And of course they suggest we get a joint sponsor which i think  will be difficult to come by at the moment .

Hi @Orkey!

I am no expert in this field, but if I was you, I'd provide all the documents you listed above (W2 from 2017, tax transcript, maybe an employer's letter stating that your wife makes xx thousand per year?).

I believe you don't need to be above the poverty guideline for the last 3 years, otherwise they would've rejected my k-1 visa, and probably yours too. My husband was also in school in 2015, so I understand your case.

 

I hope people can help you in here.
