Hello everyone, can you apply for fiance visa right away after you receive your divorce decree? Or do you have to wait for few months before you could apply for fiance visa. My ex and I are processing our divorce now and it should be final by next month, hopefully, but my now fiance wants to file for fiance visa as soon as i receive my divorce decree, is that possible? Thank you.

Hello, what if I was married in the US and was a previous green card holder, although we got married in the states we never registered our marriage here in the Philippines, so my CENOMAR shows that I am still single here. Now my ex husband file for our divorce in the states and it will be finalize soon,  my now fiance wanted to file for fiance visa as soon as I receive my divorce decree. Would it be ok to file and use my divorce decree in the states even though my record here in the Philippines stated that I'm single? Another problem is that I'm still using my husband last name but my passport is in my maiden name. Is it going to be a problem when I have two different last names? I need all of your help.

If you fulfill the requirements of the petition you can file at any time

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Depending on the state you live in you might not eligible to marry until a period of time has elapsed. For K1, one needs to be free to marry and if you state has such a waiting period  it might be interpreted that you might not be be free. you might want call the department in you county that issues marriage licenses where you plan to get a marriage license and see if there is such a waiting period in your state (or state you plan to get married) for the correct answer.

She is no longer in the states but back on the PI.  How many states actually still have a waiting period?  Gotta be the minority
