Thank you for taking the time to read this, 

Firstly let me give you an idea as to our situation.

 

1. My USC husband (BORN IN US) and I (NEW ZEALAND CITIZEN) have been married 3 years and living in UK where I was studying and where we lived for 10 years.

2. We moved to US 4 months ago with me on a F1 visa to attend university. (For my own Second degree)

3. I have completed 1 semester at university here and hate it. Like really hate it. And on top of it the school is notorious for fees and added costs which is way over our budget.

 

Here's the problem...

 

University starts back in January and I really don't want to go back as its not the right place for me or program. What can we do that won't mean leaving the country and or being in immigration trouble. Can we apply to adjust status and just not go back to college or should I sit through another semester or two and pay the $20,000 for 4 classes each semester ? Whilst we wait. Please understand the school costs a lot especially after just completing another degree in UK. We have everything as in documents and files we need to submit i130 application but I could like to know any legal ramifications or immigration problems that may happen if I don't go back to university in january. 

 

I don't want to leave the country as we just spent $30000 moving here with our 3 dogs! Please help!!!

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think you can apply for AOS as seeing you entered without intent to adjust status. Your husband needs to have residency where you now live and he needs to be able to make enough money to sponsor you or you two can find a sponsor. It might take a lot of time and a lot of paperwork to adjust status. Another thing you can do is apply for spouse visa, go back to your country and wait out the long process. That’s the most legal definite route. 

 

Remember that if you don’t adjust status and stay without going back to school, you’re overstaying and you’ll be an illegal.

You will have authorized stay status once you submit the AOS paperwork.  However, leaving the US without Advance Parole can be seen as abandoning your adjustment.
