YouI aveTexas.ided the opinion and interpretation of the OP's in these cases as to the sole reason for denial of a K-1 visa petition in one case shown above.  The instant case is a spouse visa case where the marriage has already taken place.  Different animals entirely.  A K-1 visa "PETITION" will be denied if the US Citizen lives in a State where it is not legal for the marriage to take place. We are discussing an approved petition for a spouse, with a subsequent denial of a visa during a Consular interview.

Denying a petition and denying a visa are not the same thing.  Neither are spouse and fiancee.  Interpretations are also not facts.

The spouse case was specific to Texas.  The instant case we are discussing is Pennsylvania.

I know an indian Couple who are cousin and live in texas. They have got married on 2012. They applied for CR1. Their case were denied first.but, they fighted finally their case was approved. My lawyer told me this Rule had lots of details. When i

This is not a Texas case.  How about keeping the discussion focused on the OP's circumstances?

As you know Texas is a such state That cousin marriage Is Forbidden and Sex with your cousin is charged under texas Law Wich makes Makes sex between cousin a 3rd degree feloney. I know Ali doesn't live in texas but i encourage him to gather more correct info. And doesn't give up. You can't met his heart. He is an emotional wreck. You never help him with talking about child or sth. Which you don't have enough information. As i mentioned before this rule isn't for us and if uscis revoke your case you would Win at the Court. About child: The risk is Equal to that of women having children in their 40s. Have you ever seen a woman in 40s get pergnant? It is not a huge problem really With todays Modern technology it is not unsolved problem. Althogh I think this type of couple should be more conscious. There is another important thing if they don't want child why their love have been forbidden?

Their love has not been forbidden.  A visa has been initially denied. We have potentially incomplete information as to why.  The denial may or may not be legitimate but when living in Pennsylvania, being first cousins is not sufficient reason to deny the visa.  There would need to be more to the case than that, or they will ultimately succeed.
