What exactly is your question? You fulfill the residency requirements and it looks like DNA is ok. Just file CRBA?

It's amazing how many questions can be resolved with a 2 minute Google search...

Get the birth certificate fixed and get the DNA test done not much else you can do. They did not believe you when you told them he wasn't the father. Kind of hard to believe when you put him down as the father on her birth certificate.

Putting down the new bf who isn't even the father and you are not even married to him, will just make you look like a gold digger. You might get some scrutiny from the consular section of the embassy because of this (it makes no sense why you did this!!!). And they might drag this out a little. However you just file for CRBA and should be good since you fulfill the requirements.

They want proof he is not the father because you presented a document to them (that you swore was truthful, and I'm assuming required him to do so as well when he signed it) that says otherwise and has a legal presumption attached to it. They will not take somebody's word at face value here, so now you need to comply with their request and/or get the BC fixed.
