Hi... Just a little info about my case...

First i filed for an i130 and it was approved i received a letter stating your case was approved, but the issue was someone at the USCIS said i put my wife as, was in the US.

So i had to file an i824 to have them send the approval to the NVC and then to a consulate.

It was approved the i824 and i received a letter saying they sent a copy to the NVC. It took them 3 months to say they found it (because the NVC told me after 45 days they didn't receive anything). So now after all that waiting now i notice an update on the USCIS stating this:

 

"On December 20, 2017, the Department of State sent us your case, Receipt Number SRCXXXXXXXXX, for review. We are reviewing it, and will notify you by mail when we are done. Please follow any instructions in the notice."

 

Please can someone explain what is going on ?

Why is this happening?

 

Ps

We have 2 young kids(both under 3 years old) who both are US citizens and registered at the embassy with US passport but my wife is not and we are trying our hardest to bring them all back to the US.

It sounds like an Rfe for something... part of the file may have been accidentally seperated n the process.. just wait until you get the letter... then respond and it should be back on track.

So you think they may have lost something in the process from USCIS to NVC...

You could be right based on how long it took the NVC to say they found the approval...

Do you know how long it could take to get a letter?

Did you specify the embassy where she is to be interviewed on the I-130? I have seen before where this has been forgotten and USCIS therefore assume exactly it's an AOS case in country.

 

Incidentally, there is nothing to stop you and the children, as USCs, from returning to the USA. You could come back tomorrow if you wish. If you did, you wouldn't be the only one separated from your spouse during the process. That's how 99% of us go through it.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes we choose the correct embassy and all info looks correct...

I understand nothing stops us from coming me and my kids but for me to sperate 2 infants from their mother that's a tough thing for me to do, separation of 2 adults from one another is not a big deal for for infant children i think that's to much for my wife to handle

But that was your choice - to have children before she had her visa and was able to live in the USA. I understand it's tough but you obviously wanted it this way at one point. We all know how not to have children ;)

Please does anyone have a time frame how long it could take to receive a letter?

To bring they back implies they had been here at least one time. I'm now confused.
