Hello all, and happy new year :)

I have been trying to search here to find out and put pieces together according to our situation to come up with how to do this but I didn't find much information, so I thought I make a thread.

I am still immigrating on CR-1, and never been in the US. I am currently unemployed.

My wife filed her previous year taxes as single while we were married by mistake. we want to amend that and file this year as married jointly.

She used to file her taxes with a software, so she doesn't know how to do that by mail, or what forms she needs and etc to do the whole thing now (amend and MFJ)

I learned that I need to do the W-7 attached with my proof of identification, I get that part.

what I need to know is the following:

1- for me as a nonresident alien, do I need to fill and sign any other forms beside W-7 (so maybe I can fill those forms on my computer and sign them then mail them to her with the rest of the stuff) ?

2=for my wife, what forms she need to do the whole thing and if there is a step by step guide or something (including how the w-7 fits in all that) ?

3-how to/in which form we will say/prove that I am unemployed and have no income ?

4-How to avoid my wife not getting fined for me not being in the US when it comes to healthcare coverage?

5-I was wondering if anybody has any tips for our current situation for my wife to get the best tax return/benefits

Thanks a lot guys for any help in advance and have a great new year :)

1)  In addition to the form W-7 you will need to provide the proper documentation which in many cases is your passport

2)  1040X

3)  If you don't have a form then you cannot provide something that doesn't exost

4)  You are not inside the USA so I don't think you would be subject to the healthcare coverage fine

5)  She may want to have a consultation with a qualified tax accountant

YMMV

I meant, is there a form required to fill that its purpose is for stating that I have no income?

if anybody has like step by step instructions for what we need to do in our situation too, I would be very grateful, meanwhile I will keep on fitting the pieces of info together to create my own guide.

thanks

There is no tax form on the US side.  She simply prepares the 1040X with the corrected information

YMMV
