Dear all,

We have now been asked to provide divorce proof from each of our FIRST marriages although we have already provided proof of our SECOND subsequent marriage's divorce.

We got an RFE on 8 Dec which we complied with and returned then a second on 22 Dec asking for this additional proof. I have been married twice before, my partner twice too plus a long common-law relationship (his last one). My partner doe not have the certificate from 40+ years ago and we are familiar with what is needed having to go to LA to request one etc (having already been through this unsuccessfully!! In the case of his second marriage we ultimately got a death certificate as his ex subsequently passed)

This feel like total red tape simply to obstruct. I have not seen anything in the instruction to provide proof of ALL previous marriages, only the last.

Has anyone else encountered this or challenged this? I do feel that all we can do - again - is comply. We have already been seven months in process and not got as far as NOA2.

Why was this not asked for on 8 Dec when they sought the death certificate or proof of no certificate for the last marriage?

I had two previous marriages and had to provide the full divorce decrees for both.  It's a hassle and the divorce decree from California included all the divorce settlement information that was attached and was made part of the divorce decree.  That's over 30 pages.    It's required so had you submitted all of them to begin with you would not have gotten the RFE for it.

Yeah I see that now. Don't know how I missed it! Or why they didn't say this a month ago in the first Request for further evidence...

Yes I see that now, thanks. The first RFE was in relation only to the second marriage and a couple of pieces of missing info. No request for anything of the first. Onwards....

Human Error?  I don't know the process the adjudicator uses but my guess it was missed upon the initial review and when they got the RFE evidence they realized they missed something

and you were to list all previous last names and explain why from maiden name to current name

list all marraiges

all divorces

all deaths of spouses

all children (even stepchildren) of both 

certainly you got divorce papers at the time of the divorce

if you could not obtain a set of new ones,  you could copy and have them certified as a true copy

reasons for this is some states are not connected and easy for a person to travel and remarry without showing divorce 

even i could have married in morocco without showing death certificate of my late husband as i had kept my maiden name and had all the proof i  needed to show my birth certificate and ID 

that being said,  it is the reason for needing to show ALL maraiges have been legally dissolved

Detailed information on children of the beneficiary.

 

For the USC, only need to answer a question regarding minor children (Y/N) and ages

sorry but my kids are welll over  30 and i got an RFE to send their birth certificates and claim them (both married with their own children)

the instructions say "list all children" and immigration means it

 

if i knew how to post my RFE on here i would

sorry but i have a child over 20 living with me while attending graduate school

and i had to list all mine 

they want to know all family living in the house for the financial affadavit

OP is K-1 and therefore I-129F.  I suggest you understand the differences between the requirements of the I-129F petition and an I-130

Petition versus affidavit of support.  Two very different things

i did both the K1 (denied) and CR1 

i had to list all children

Take a look at the current I-129F.  No question or place to list detailed information for children of the USC

In California my husband went to the court house where his divorce got finalized and got a copy of the divorce record. We paid like 26$ so their is a record everywhere it's super easy to get!
