Hello everyone, I'd like to know if anyone can help me with this. My ex and I are processing our divorce and it will be final soon, and right after I will receive my divorce decree, my now fiance wanted to file for a fiance visa right away. The problem now is that, I am still using my ex husbands last name but my passport is still in my maiden name. There's no sense of changing it now to my married name when my husband and I are getting divorce anyway. My question is what last name Am I going to use for my fiance visa? My married last name or my maiden Name. If I use my married last name would it be ok that my passport is still in my maiden name? I'm confused.

You have to use the name on your passport

Thank you for your reply, but I have a previous record in the states. I was a previous green card holder and my divorce decree will be still in my married name, would it be ok to use my maiden name  on the fiance visa? It's the name on my passport

You  can take some time to do this

as some have found out filing for K1  right after a divorce,  gets a denial

don't rush even if separated for long time

it is the divorce date they look at

If you are USC it is going to look like you doing marriages just to help foreigners get green card

if you are the bene of a Visa,   looks like you married the USC for a green card and had bf back home

 

not saying this to make judgements and don't take it that way

i am saying what we have seen happen  to others on this site

hope your new relationship works as we all know divorce is hard and we are not wishing that on anyone

so very sorry

Thank you for your concern and advice. I am a little worried about it. Me and my ex has been separated for quite sometime now, He cheated on me and played with my feelings for awhile. I ask for divorce but He decline it at first because he was enjoying with his life going back and forth to US and Philippines. I've known my now fiance for 2 years now but we can't move forward because my ex didn't want to divorce me even though he has another woman. at first my ex told me we could go back to the states together and He could file me a spouse visa again using DCF since he's been living here for awhile, and I agree thinking once I get to the states again I could finally divorce his cheating ###( sorry for the language)...  but He changed his mind again when He found his current girl and  he finally decided to divorce me. My fiance and I had been waiting for this miracle to happen, that my ex would one day wake up and file my divorce, and now that it's finally happening we don't want to wait any longer..I'm just concerned about all these paperwork and legality. I don't want to be denied. I'm worried what last name should I use, should I use my maiden name on my passport or my married name on my divorce decree.

your new fiance can not fill out for fiance visa to you without you get divorce, you need be divorce first then apply for the visa.

you will need use the name you have on passport is ok and if you have used the last name of your ex before, just list the last name in others names used

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

What is your current legal name?  Did you change your name when you got married?

Hello, thank you  all for the response.I was using my married name in every paperwork I have in the states before, and also changed my last name to married name here in the Philippine comelec where I vote, and also use my married name when I went to college here, but I didn't get to change my last name in my passport. I made a mistake of renewing my new passport but still in my maiden name, and there's no sense of changing my passport to my married name now when any time now my divorce will be finalize.
