Question on which visa?

Hello.
I hope this finds you all well. My friend saudiwife told me about this page. I hope I can find the answers I am looking for. My  fiancee is Moroccan, but living in Riyadh, Saudi Arabia.
I'm not sure what visa we should use. The reason is that I was previous married to a Saudi. When I was married to the Saudi, we did an Adjustment of Status from his student visa. However, a year after he received his 10 year greencard, he left the United States.
I do not know if he is coming back and forth into the country, since we cut off all communication. We separated June 2016, and our divorce was finalized August 2017.

I am not sure which visa would work out for us. I have heard that Morocco is considered a high-fraud country, I don't know how true that is. Anyway, he is seasoned gentleman. He is in his mid 30's and I am in my early 30's. He does have a child from a previous marriage, but he is considered well-off in Morocco and Saudi Arabia. I am wondering would it be a big deal, because I am divorced, and planning on filing in a few months. Or should I wait? I am just trying to figure out that best route for us to take. I know things are hostile against majority Muslim countries right now, but i am just concerned.

Any advice is helpful.

That makes no difference in which visa you would choose to pursue, only makes a difference in documents you have to provide, which one to choose is really up to you, with one you're a LPR upon entrance, with the other you're not.

Received case and invoice numbers: 9/12/2017

Choice of Agent DS-261: 9/12/2017

Welcome Letter: 9/15/2017

Received and Paid AOS: 9/15/2017    AOS payment cleared my bank: 9/19/2017 (still shows In Process on CEAC)

Received and paid IV bill: 9/19/2017    IV bill cleared bank: 9/21/2017

Requested Expedite: 9/20/2017

AOS and IV show as paid: 9/23/2017

DS260 unlocked: 9/23/2017

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

Go and marry

and go thru the CR1

he will need criminal reports from both Saudi and morocco

In Morocco you have to apply in persone for the 2 criminal reports called 

1 Morocco anthropomtrique 

2 Morocco casier judiciare

 

before he leaves Saudi make sure he gets the criminal report from them / he will have trouble trying to get in from Morocco

make sure his child is listed on the applicaiton 

 

keep copies of EVERYTHING you send to USCIS

and send originals (other countries can send copiies but USCIS wants original marriage from Moroccan citizens)

when you do any correspondence later for your application make sure that you put case number, both names and both DOB's on upper right hand corner of each and every page

it is important that you have his family's approval 

i know it is hard to get photos of them with you because of your living arrangements now so if you can,  marry in Morocco 

 

no matter which application you try  all documents must be in native language and have an Engish tranlation

in case he returned to morocco to marry it takes about a month to complete the process

he can, (not knowing his situation) return to Saudi and even ask to interview there

His job is in Saudi Arabia. So even if we decide to do the marriage in Morocco, he will have to go back to Saudi for work and I back to work here in America.

I am wondering if we do a CR1 application would the filing be under Saudi Arabia or Morocco?
He only goes to Morocco for visiting family.

How would be able to request an interview in Saudi Arabia? I am totally new to this way of doing a process. I know we are planning a small wedding in Morocco when he and I are able to have a small vacation. However, he will have to go work back in Saudi and I here in America.
Would I put on the application he is in Saudi Arabia? I, myself, wouldn't want him to miss too much work flying from Saudi Arabia to Morocco for a interview.

He can go to the US Embassy of his current residence

Based on his mailing address in Saudi would be the first indication to have it there

Visas are not given out with frequency in S.A. or in Morocco. No matter what you decide it's best to have many visits, many cr1 from Morocco aren't approved in 1 short visit and you do know it takes generally 2-3 weeks to get married in Morocco. There's many steps involved, I just got married there last month.

It’s worth mentioning that he needs to be a legal resident of the other country in order to request the interview to be done there. Not sure what your situation is but just thought I should mention that.

Have you actually met in person yet? If so, how many times? The more visits, the better your case for Casablanca.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

Immigrant interviews can be held at the Embassy/Consulate of your Nationality, Country of birth or principal RESIDENCE which is a little different than being a legal resident

If a person is there illegally I doubt they would. That’s what I said.
