Should I do K-1 or CR 1 VISA?

Hello

i am writing for a friend. Her fiancée is Moroccan and living in KSA. She wants to apply for him, however she doesn’t know what visa she should do that will get him faster. 

 

She knows Morocco has a bad reputation so she doesn’t know if she should get married and then apply or do a fiancée visa. 

 

He is older and seasoned if that makes any difference. He does have a child from a previous marriage. Would these be considered red flags?

Nobody can make that decision for the USC.  Each visa has it's positives and negatives...  Understand the differences and decide what is best for the individual situation

Since she is not married to him now, they have flexibility.  But I think the term "faster" may cause problems just because the visa process isn't necessarily a fast process.  They may apply for the fiance visa and be just fine with their evidence, interview and whole process or they may face AP.  If a fiance petition is denied by the DoS, then the next option is the marriage visa.  There are no appeal rights with a fiance visa, but there are with the marriage visa.

 

However, since he is living in KSA, then they should not face too many problems getting married if he is a legal resident there if the fiance visa faces problems.  

 

I think those two other items could cause questions for the interviewer, but I doubt the DoS looks at them in isolation.  It's not a unique situation and Moroccan men are not banned from getting US visas, so it is what it is.  Some people face an extraordinary amount of hurdles.  My husband and I's case could have had plenty of "red flags"  but that didn't cause problems for us.  You just need to go with it and provide evidence of a bone fide relationship.  In our petition, we provided evidence of how we met initially, our meeting and a bunch of other fun stuff.  Just need to pick a visa, spend the money on the fees, prepare for the worst and hope for the best!
