AOS and 30/60 Rule for TN visa

I am on a TN visa since Sept 2015, and it expires on Sept 2018.

 

I got my PERM approved in Mid November, 2017. It expires in May 2017.

 

I am Canadian citizen and Colombian, with a mechanical engineering degree from Canada, my wife and two small kids are Canadian.

 

I wish to concurrently file for I-140 and I-485.

 

I just came back from vacation in Canada (I crossed the border to the US in Dec 27), and just found out about this 30/60 rule.

 

I had spoken with two lawyers before, one agreed I could travel before the i-140 and i-485, the other one was not against it but did not recommend it given my time remaining as TN.

 

If I file for i-140 and i-485 via adjustment of status next week, am I in danger of denial ? or would it be better to do it via consular processing ?

PERM is the labor certification and is tied to the DOL (Department of Labor). It is necessary for EB2 non NIW applicants.

The company is sponsoring my green card.

If the company is sponsoring your green card, why are they not including your family one the petition as well?

Sorry, I misread your question.  I thought you were asking about your families' AoS, but you are asking about your own.
