j2 holder waiting on EAD

Hi,

I am getting married this month to my fiancé who has a j1 visa.

I am a software developer in the U.K. currently . 

  1. When I enter the USA, can I work remotely for a us company (or the UK company I currently work for) while I wait for my EAD to come through?
  2. Is it true that I should wait a period of time after entering the US to apply for the EAD?
  3. Also, do I need to stay in the USA while my EAD is being processed, after I've given the biometrics?

Work remotely for a US company while in the US? So you mean "work for a US company". :P If you're both in the US, then whether you reside on site or at home (or somewhere else in the US), it's all the same. No, you cannot work for a US company until you have work authorization.

 

Working remotely for a foreign company and being paid in the foreign currency is a gray area...it's an intersection of tax and immigration law that has not been clarified. Some attorneys believe it is permitted, and others believe it is not (until work authorization is obtained). The exact circumstances may matter (i.e. if the company has a US branch, then it may cross the line). Unfortunately, I cannot give a clear opinion on whether this is permitted or this is not permitted. Others have done so fine (not that it makes is necessarily legal). Either way, taxes would need to be filed.

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received
