K1 Visa for El Salvador Beneficiary

Greetings and Happy Holidays! In the past I inquired about several different topics in regards to my K1 Visa application and I am happy to say that on December 25th, my girlfriend said yes to my proposal. Thanks to the advice of the forum members, I have my application ready in my opinion to submit. I just wanted to outline what I had to see if I was missing anything or if anyone had any last advice before final submission. Thanks again, and in the future I hope to use my learned knowledge to help others.

 

This is what I have:

Cover Letter outlining Document

I129F, filled out completely, honestly, and accurately. Typed. Signed.

A Written Statement about meeting in person twice this year. Included about sixty photos total for both trips, boarding pass, hotel and airbnb info, passport stamp of her travel to Japan with me, flight receipts. 

10 pages of Skype calls showing long calls and 10 pages of Facebook conversations that show intimacy (PG of course). For this I was told by members not to include hundreds of pages of evidence so I only took screenshots I found relevant.

Intent to Marry Statement signed by both of us, with the address of wedding location and estimate time frame for wedding.

Pictures of engagement ring, her wearing the ring, ring receipt, and Facebook status page of engagement with interactions by family and friends.

G325 A for both parties and passport style photos

Birth Certificate and Passport Photocopy for Petitioner

Personal Check for $535 for I29F Fee.

 

Special Circumstance:

The new I29 F requires disclosure of all crime by the petitioner, not just certain ones anymore. I have two petty thefts that are 6 years and 8 years old respectfully. I included notarized final dispositions and a written statement disclosing arrest dates and conviction status and dates, along with a brief summary of the incidents. I then included a statement to indicate how I have changed over the last 6 years and how am I no longer that kind of individual, to support my statement i included before and after photos of myself (lost 100lbs since then), and a photocopy of my bachelors degree I got this year to show evidence of change. I was told these charges will probably not effect my application as long as my spouse is aware of them (she is), but I would rather be on the safe side to prevent any complications or RFEs. 

 

 

Also a few sidenotes:

We do not have a large age gap. 27 and 28. But we have only met in person twice. We do not share a common language. She speaks Spanish and only a little English and I speak English and only a little Spanish. We use translators often and we are both learning each others languages. Relationship length. 7 months from meeting on Facebook until proposal. (5 months since in Person). No prior marriages for either. No Criminal background or medical complication for beneficiary.  I do meet the I134 Income requirements. 

 

Am I missing anything guys? Any red flags that anyone can see? I think the I29 is looking strong. I am worried about the interview as I have seen some denials based on lack of bonafide relationship by other Vjourney members. Any advice or experience with El Salvador consulate is appreciated. Thanks!

You should be fine overall. Only thing I see is make sure you have the right 129f form. You said you included the g325 but for the new 129f you don’t submit that because it’s already included in the new 129f. So check that because if you submit the wrong form you get rejected and have to start over. You are also not sending her birth certificate and translations, I think that’s a requirement as well. We included that. 

 

Also I think sending 10 pages of Skype calls and 10 pages of Facebook calls is too much. That’s all secondary evidence and it only slows down your processing time because it’s more stuff they have to go through. We didn’t send any of that only primary evidence and got approved without RFE. I don’t think it’s necessary to send Facebook status of engagement either. No one cares about social media status and neither does USCIS. 

 

You mentioned sending her passport stamp from the trip to Japan where you met. Did you also send yours? Because that’s how they can prove you have both met since you met at a third country and not each other’s. Make sure to include that. 

 

I don’t know what your criminal background will do for the petition. Might wanna ask a lawyer that. 

 

I don’t think you have anything to worry about in regards to evidence of a bonafide relationship. It seems you have that so you shouldn’t be worried. 

 

You don’t have to submit any wedding plans for now and honestly you can’t even have any wedding plans because you don’t know how long it’s gonna take to process this visa. She can save wedding plans for the interview but even then don’t set a date, or book a venue or even send out invites or save the dates because you can’t possibly know how long it will take. 

 

Look over everything you are sending with your petition, word by word, letter by letter to make sure there are no mistakes and you didn’t forget anything so you don’t get an RFE which will add even more time to the long and awful journey that is waiting for USCIS approval. Make double copies of everything you send, she’s gonna need to take the whole thing to the interview with her. Don’t use USPS to send your stuff, use fedex or ups and make sure you have the right address. Good luck.

Wow. Great advice. I saw some people including the G325A so i have it ready. I do have my passport info as well. Are you sure I need her birth certificate as well? I only saw I needed mine.

I don’t believe you need her birth certificate in the packet. I’m due to send my I-129F packet out today and I didn’t see anywhere that said to send my fiancé’s Birth Certificate. Only to send mine/proof of citizenship. She’ll only need that on the date of the embassy interview, if I’m not mistaken.

Our lawyer asked and sent them. Along with translations if it’s not in English.

I just realized they ask for front and back of birth certificates and i only sent front because it had no back. I also sent my passport page identification page and all the pages for the countries i visited but not the blank pages.  Am I going to be hit with an RFE?

Only thing required of the beneficiary for the I-129F is a passport photo, statement of intent to marry, termination of previous marriages (if any).

I did the same and was fine
