stamp denied for second time help!

Hi all 

Today I went fo second time to the uscis office and the lady that was there didnt stamp my passport. she said al least need to be 2 weeks before expiration date on the green card. 

I said all in this forums are having their passports stamped with one month on anticipation and she challenge me to show were in the uscis page say so. Please if someone saw that one month regulation let me know.

tomorrow is 3 weeks for an expiration of my green card. I told her to stamp she said NO I travel on saturday and she said ..well maybe you shouldnt travel.????.

 

Other thing she worries me about was she said It can not be in my italian passport stamped because I was born in other country so only will be stamped in my original passport country??????I was whatttt? I dont even have that other country passport .

she said I need to show her probe of citizenship and I said ..well you have my passport in your hand....she said its not probe of citizenship only the born certificate...I was whattttt?

She said all my papers were done were done with the born country ...that really astonish me because the copy of my passport and all the papers were done with my italian citizenship.

I showed her the copy of the forms I fill for USCIS with the dual citizenship and she said ..well those are only copies no facts

what to do ..please someone have had this kind of problems before ..help and advise.

Most of us get the stamp around the time the EXTENSION LETTER is about to expire (not the green card).

In general, nobody here goes gets a stamp if Green Card is about to expire, as mostly all have already filed for I-751 by that time and have the extension letter in hand (Therefore, no passport stamp needed)

Did you file I-751?  You have no timeline her so it's difficult to put the pieces together.  You don't get a stamp after submitting the I-751.  What you get is a notice form USCIS that your green card is extended one year.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It still does not state the right to have our passport stamped one month before the letter of extension expires.

I didnt find were say what time frame we have to present ourselves in an uscis office with our passports to have them stamp it...she said the regulations is 2 weeks ? I rely upon that in this forums people get stamped with one month of anticipation. She challenges me to show her I find the regulations about the time frame to stamp my passport.on USCIS PAGE ....I didnt find nothing. yet so I came back second time home with no stamp in my passport and another tryp to USCIS for nothing (the first time another officer said I need to wait till there is a month to expire my extension letter) another day without working.

It says if it is "about to expire"...kind of subjective, I know..

Technically the date on the extension letter has nothing to do with the expiration of your conditional resident. It should be from the date of your conditional green card. Did you show any ticket reservation that you will travel and mentioned to them that during the time of your travel your one year extension of being conditional resident will be expired? Usually they give stamp if the duration of your travel is within the expiration of your one year extension of being conditional resident.

OP, sorry but it sounds like poor planning on your part.  You should not be traveling until all paperwork is squared away.  Actually, you can leave, it's just that you can't come back.

I went to the office twice! Im the most planning person in the world! the first time was a month before expiration ...now it was 20 days before expiration of my green card and I got the tickets long time ago and YES I SHOWED the tickets to the 2 of them ...the first time lady say came in 2 weeks you will get your stamp

Sorry to say but we are at the whim of USCIS, not the USCIS at our whim.  Since you did not wait until paperwork is squared away, now there is a problem.  Anyway, you can still leave for over 2 weeks.  I know it sucks but you can change your return date to get back prior to the one year expiration date on your notice.
