So my situation is kind of unique. I am Madly in love with the father of my oldest child, Before our daughter was born he was going to take a trip back home to see family{mexico} apon his return  he was stopped and was told that he didnt have the right documents to reenter.  

So they offered him a Voulentry departure. 

 

Well in the mix of things they found that he had a id dated past his visa ( so it looked like he over stayed) so he now has a 10 year bar. He is 7 years in to the bar and we are wondering if there is anyway he can come back befor the bar is up. If we need to get married (we plan on it anyway) orif he can come on a K1 visa?

 

 any ideas?

Simply is not enough information to make a sensible answer.

 

Certainly may be possible.

 

When was the last time you visited him?

 

Have you consulted a Lawyer?

He can apply for a non-immigrant visa and hope the CO recommends a waiver, but this is honestly a long shot IMO.

 

How old is he? I'm assuming at least 19 since unlawful presence only accumulates after age 18, and he got a 10 year bar for 1+ year of unlawful presence. But the precise age is important for determining what visa options are available/realistic.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

So you have had other children since he's been back in Mexico?

 

Of course there's no rules saying you can't fall back in love with previous partners you may have more to prove that this is a bonafide relationship and not just trying to get a greencard for an ex-boyfriend.

I'm not implying this is what you're doing, just giving you a heads up as to what a CO might think. Especially if you need to apply for a waiver.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
