Income/Assets Requirement

Hello, 

 

Me and my husband both currently living and working in Canada. I am a US Citizen and as we both decided to move to US now, I filed DS-260 and I-864 to sponsor my husband to become permanent resident of USA. I do not have a source of income in US as I work in Canada and have Canadian income. I have been filing yearly taxes in US though. We decided to use our combined assets in lieu of income. We have more than 200K of assets, as per the I-864 instruction guideline, we multiplied the income shown in poverty guideline(2 person household) which is $20,300 by 3 which is approximately $70,000 USD. Yesterday we got the following messages in CEAC : 

<Sponsor> does not appear to meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. To view the current poverty guidelines, please visit https://www.uscis.gov/files/form/i-864p.pdf. In order to avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor to assist in sponsoring the intending immigrants may be submitted. If joint sponsor is used to assist in sponsoring the intended immigrants, please note that a Form I-864EZ may not be used and a Form I-864 must be submitted, if it has not been already.

 

We called in to the call center at  NVC, the agent advised that they only look at Last year US tax filing, which shows insufficient income so the above comment by them. They do not review the assets and other information submitted by us and the US embassy in Montreal would review this.

 

My question is that should I wait for the Interview and risk a rejection or have my parents become co-sponsor on this application? Has anyone been in the same situation. Can you please advise or share your experience on this matter? 

Note : We have also provided sufficient proof of US domicile.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Timeline

NVC always sends that notice when income is not sufficient.  Assets are not evaluated at NVC.  The Consular officer will do that.  If the assets are liquid and properly documented, no problem.

Facts are cheap...knowing how to use them is precious...
