Travelling to us while waiting for noa2

Hey me and my fiancé who is in the US have been talking about me going to the USA for a month or two since I have been let go from my job and I still have a place to stay in the UK which isn't a problem, the main risk we think will happen is that we don't want to risk me getting returned back to the UK when I get there, she can fully support us both and she is willing to be the advocate. Since I have no job and willing to support me when I'm over there will there be a issue with customs when I get there? 

Of anyone has had this experience I would really like to know how it has been for you or if you know anything about it

It is possible to visit her. But You will need to show evidence that you intend to return to UK after your visit because entering the US via VWP with the intent to stay and adjust status is illegal.  It can create severe consequences if the border agents even SUSPECT that.  You could lose WVP ,and be barred from entry.   That means you will have to show strong ties to your country.  Her ability and willingness to fully financially support you while here is not favorable to your case.  In fact, it could be seen as stronger evidence that you intend to stay in the US and adjust status.

You can try to enter for a visit, but the chances of you getting into the US is not 100%.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah I understand that and was expecting something like that, I have full intentions to return back to the UK as the house I'm living in with my brother has all my stuff in I'm not sure what type of evidence I would need to come back apart from attending the interview and medical ect. Just rough times being away from each other, we do talk each day through Skype ect but I'm unsure what evidence I could use to return 😓

I have seen people who posted that they successfully visited their fiance/spouse.  They said they brought paperwork showing that the were waiting on the NAO2 which helped.  As long as you don't have the intent to enter and stay, maybe it's worth trying.  

 

Do you have a current lease showing you are obligated to pay rent in the UK?

Do you have any other obligations which would demonstrate your need or desire to return to the UK while waiting?

Yeah I agree with you and I see that, 

Also I have a Tennant agreement that states I currently pay rent as well of council tax. 

I know saying even going for a month or two might not be enough but when coming to ordering the tickets to go over the date to return is when I will actually be returning but we have said to each other that they wouldn't even care as it can always be cancelled. 

Just really hope they speed things up after the holidays because our noa2 is expected around April as we are October 2nd filers.

I understand, believe me.  My wife's CR-1 visa took about 13 months from filing until visa in hand.  The waiting is not fun at all, but the end result is worth it.

I have visted the US twice from the UK on an ESTA since having our K1 visa in. The last being 17th December and I am still here now staying for a month. 

 

The first time I entered I was with my parents in October the POE officer asked us why were coming to America and I said I'm here to visit my fiance check out our wedding venue and for my parents to meet his parents, he laughed and said oh God you're marrying an American and stamped my passport. 

 

This time I got asked how long I was staying and I said a month to visit my fiance. And he said have a nice trip. 

 

I did however bring my K1 visa info with me incase I was interviewed. I do not have any ties to the UK now as I have just left the military so I have no job or house the only thing I have is my car and all my household goods in boxes at my parents. 

 

My advice is to just be honest but don't give more info than asked. 

 

Yes you could possibly be rejected and returned to the UK however if you can honestly say you are going to return to the UK you will be fine. My response was going to be we have waited 7 months for a NOA1 still waiting on our NOA2 but it's close why would I ruin my chances of having my visa denied at this stage.
