My wife and I got married in Status using my K1 visa, we have applied for AOS/AP and EAD. Since we received the EAD/AP in Dec and we are in Brazil now, I am wondering if I should change my status in Brazil from single to Married? If so, how would that work?

 

@izavox or @p-ana do you guys have any idea of how this works? (if needed?)

8/23/17  --- Received hard copy of NOA

10/17/17 - Case Is Ready To Be Scheduled For An Interview

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

Yes, you need to go to your local cartorio. It's been awhile since I did it, but I remember needing both of our passports and our marriage certificate. There might have been something more like the RG. Due to the holidays, the cartorio may have limited hours. We were only in Brasil for a short time for Christmas, so we had to request that they expedite the paperwork so we could have our passports back to travel. I remember too that we went to our local Brazilian consulate here in the US to register our marriage as well. I believe we did that prior to registering in Brazil, but I'm not sure if that is a necessary step or not. Hope that helps!

You need to go to the consulate and get a brazillian marriage certificate. After that she needs to go to a cartorio and request another marriage cert based on the consulate one and after that she needs to change her name to married name on all her doc like cpf, rg etc.

Thanks @menina and @julis82 for your quick response. So it seems to have quite a few things to do, but @julis82 I'm still not sure I understand what you said...

 

So I'm the beneficiary (man) my wife the US Citizen, what if we decide not changing the names? When you You need to go to the consulate and get a brazillian marriage certificate ",  considering we are in Brazil right now, where would I get that?

 

When you say " she (which I'm assuming is the beneficiary) needs to go to a cartorio and request another marriage cert based on the consulate one " will I still need to change all of my brazilian documents such as CPF/RG etc?

She needs to requesta brazilian marriage certificate. If you lig in to the consulate website there's a option there in how you request it. Once you have that she can go to cartorio.

We had the same situation as you. My husband is from Brazil. He did not need to change any documents such as RG/CPF because he wasn't changing his name. After reading the response from julis82, I seem to remember that we did need that brazilian marriage certificate from the consulate before going to the cartorio. There was some kind of timeline associated like once we had that certificate from the local consulate in the US, we had something like 6 months from the time we entered Brazil again to go to the cartorio. The consulate website should be able to give you more info but I think you will not be able to register the marriage at the cartorio during this trip. I believe that timeline won't start until you do the first step here in the US and then enter Brazil again. Hope that helps!

Hey @T_P, it's what @menina mentioned above. You need to start the step here before doing anything in Brazil. I changed my marriage certificate on the consulate here, and if you live in a city in which they have a brazilian consulate, you can do this in about an hour. If not, you can do it by mail in which it might be done in a week or so. 

After that, you go to a 'cartório de registro de pessoas civis' in Brazil, BUT here is what I found tricky =( ....

You'd have to get that marriage certificate (the translated one) 'apostilada' on the Office in which your birth certificate was issued. After that, the office can issue you marriage certificate. If your family lives in the city you were born, than that should be easy =)

 

For me it was a complicated issue because where my family lives now is far from where I was born and the 'cartorio' in my current city didnt make anything easier for us. Unfortunately, I wasnt able to update it for lack of time but I will the next time I visit. However, having the translated marriage certificate from the consulate helps you out with a lot of things, such as getting a new passport, updating your CPF and Titulo de Eleitor.

July 6, 2021: Previous biometrics reused

November 8, 2021: Permanent Green Card Approved!

July 8th 2017 - Mailed AOS packet

July 11th 2017 - PD

August 14th 2017 - Biometrics Appt (for I-485)

August 21th 2017 - Biometrics (for I-765)

August 24th 2017 - Updated online for Case Ready To Be Scheduled For An Interview

October 16th 2017 - Advance Parole Approved (after 100 days)

October 20th 2017 - Received Advance Parole in the mail

November 16th 2017 - 'New Card Is Being Produced' (after 108 days)

November 25th 2017 - Received EAD in the mail

 

August 16th, 2018 - Status Changed to "Interview Was Scheduled"

August 25th, 2018 - Interview Scheduled For September 25, 2018

September 25th, 2018 - Green Card Approved at Interview

October 3rd, 2018 - Received Green Card In The Mail
